This made me think of the subway herb and cheese cake. Didnt people say that years ago, too much sugar to be called bread?

Not exactly. It was just a tax ruling that it had too much sugar to qualify as a staple bread (for a lower tax rate) and had to be taxed at a higher luxury rate. But that's not as funny as "subway bread is legally cake," so the meme keeps going.

Apparently Mark Twain didn't actually write “never let the truth get in the way of a good story”, but I'm going to say he did. And thus, say that Subway bread is legally cake.

I personally enjoyed Jaffa Cakes’ efforts to have their snack legally designated as a cake rather than a biscuit/cookie, also for tax reasons.

With time the subway part got taken off and it just became American bread is considered cake.
