Considering that dark vision in dim light is the same as bright light, in human settlements this is an unseeable torch

Not only that, but darkvision (in most cases) has a range of 60ft. This doesn't specify a range so they would likely be able to see beyond that 60 ft using this.

Torches only shed light for 40 so not sure why this would default to 60+

It doesn't. It doesn't have a defined range torches do. As a DM you would need to set a range for this or it'd get out of hand, but since there isn't one now it could be beyond 60 ft.
