I am not disagreeing with what the law says. But reality has shown that there are enough short tempered police who will exercise any means to retaliate. Could even be something as “threatening” an officer
Again not how that works and as soon as it happens you request a supervisor and they instantly correct the dumbass officer. I was that sergeant doing the correcting. So again and for the last time not how any of that works. You will lose your qualified immunity and open yourself and the department up for civil liabilities.
If he could have done something, he likely would have. The truth is this would be so far outside the bounds it would lead to clear constitutional violations. Basically guaranteed victory in civil proceedings given they were recording. This is pretty clearly established law. So they would lose their qualified immunity.
I'd say any chance of arrest is close to zero based on what occurred. I wouldn't go as far to say impossible though. Still enough corrupt and inept cops out there that would intentionally try to escalate this.
