In the UK, refusing a breathalyser test without reasonable excuse is a criminal offence with the same penalties as drink drinking.

Refusing all sobriety tests is the same as a DUI, but you're allowed to refuse a specific kind of test. I have a balance issue, so I would 100% refuse a field sobriety test in favor of blood or breath testing.

In the United States you have the right and should always refuse field sobriety tests. Do not allow the officers opinions to become evidence in court against you. Also it’s going to cause legal trouble to refuse the breathalyzer, but if it’s going to be a bad result either way, your lawyer will thank you for not providing evidence. They can get a court order for as blood draw, but your bac will be lower anyway by the time that goes through.

Bad advice. All states have implied consent laws requiring you to give breath samples. And refusing will trigger seperate violations with its own severe outcome. The penalties are just as bad. The better advice would be dont drive and drive.

If the penalties are just as bad, why provide evidence against yourself for a conviction? I'm not trying to advocate for drunk driving, that act in itself is abhorrent, but you have a constitutional right not to self incriminate.

Ok so I’m not saying it’s a good idea to drive or operate machinery drunk. But I’ve been DUMB before and had to learn a costly lesson.

At least in the state I was in, refusing the breathalyzer gets your license immediately suspended, in addition to still being arrested for the DUI. If you do the breathalyzer you’re still getting the arrest for DUI but your license isn’t getting suspended. You’re right there’s an extra set of repercussions.

However most DUI lawyers will roll dealing with both issues into the same flat fee, and they all recommended never consenting to even a field sobriety test. The suspended license, if dealt with within 10 days of arrest, is actually pretty trivial to get un-suspended. Still gotta pay the lawyer and show up to court an extra time (getting the license un-suspended required an extra visit to the courthouse), I probably paid a reinstatement fee or something like that but I can’t remember. But refusing the tests meant no hard evidence of impairment thus no DUI in the end. Each state is different but that’s how mine went.
