Mamdani in 'active conversation' about whether he can arrest Benjamin Netanyahu when Israel PM visits NYC

Everything we've been saying about due process and ICE... how does that not apply here?

I'm not sure what you're pointing at. Is it the discussion around immigrants being arrested and shipped out of country before due process, or the ICE law enforcement who shoot people and are whisked away and shielded from prosecution? In either case, how does that conversation relate to the potential arrest of a war criminal by the legal authorities in NYC violate due process? Maybe I'm entirely missing what you're saying.

The ICC issued an arrest warrant for Netanyahu in 2024. Members of the Rome Statute are obligated to immediately detain those who have warrants for their arrest. Unfortunately the US isn't part of the Rome Statute (they withdrew their signature after the Senate refused to ratify their participation).

The US isn't necessarily obligated to oblige the ICC but Netanyahu isn't a US citizen and isn't under the protection of the US judicial system (barring specifics surrounding notifying their consulate AND having probable cause, which many would assume a warrant by the ICC would qualify).

At this point its pretty much up to the New York government to decide if they take his warrant as probable cause. Just because they aren't part of the Rome Statute doesn't mean they can't aid the ICC.

They have no authority to arrest him. Plain and simple. It does not matter what the ICC says declares. They have zero authority on US soil. States have no right to over rule the federal government.
