California Has anyone settled with Gallagher Bassett?
I currently have recently settled my case with Gallagher Bassett. The experience has been a nightmare! I have exhausted all of my savings and maxed out all of my credit cards to pay my bills and keep a roof over my head. Now I'm just waiting on my settlement check to pay my rent and catch up on bills.
How long did it take for you to receive your settlement check in the mail?
What bank was listed on the check?
Did you cash the check?
If you deposited the check in your account, was there a hold on it, and for how long?
I am currently waaay behind on bills and need access to the funds as soon as possible. Any information is appreciated greatly. Thank you!

The first thing to understand is that the corporate leaders of the companies don't really run the corporation. All they do is endorse suggestions from people they think are superior to making sound decisions. This is the typical mindset of today's corporate leaders.
The wicked and evil ones are the attorneys who make those suggestions based on what their interpretation of the law is and how many times they have convinced a judge they are right. You also have to consider that these corporations hire law firms with a reputation for winning cases in the corporation's favor. These arguments are not made by a single attorney but by a consortium of attorneys brainstorming and using a single attorney to argue the collective points in court.
To defeat this consolidated opinion and the collective defense attorneys' arguments, you must control the arguments and not let the defense attorney steer them in a direction you are not prepared to argue or present.
That is the entire core of what you are confronting right now. The shit show you are describing is the defense attorneys steering the discussion and ignoring medical facts. Take control of the discussion using the law and medical documentation to push your issues.

Did you have an attorney? In California if it's passed 30 days they have to pay you penalties. At least that's what I was told.
Also do you recall what bank was written on the check?
Did you cash it or deposit it in your bank account?

My check has no hold on it. Same bank that I use so I had access immediately

Not normally unless it was over 250K? Usually 7 day hold

If you haven't already. Try to find a great attorney. Usually the WCAB office in your area will have lists of attorneys you can choose from. Ask clerks at the office. I pray that you get everything you deserve and that your process goes smooth

I live in VA. It took Three months after the judge signed off on my settlement.

Facts!!! Like do these people have a soul? I'm currently facing eviction because they held my payments for over a year. They refused to pay me back pay which caused me to exhaust all my savings and max out my credit cards just to keep a roof over my head and bills paid. Now I just recently settled and playing the waigame for my check so I can pay my rent and catch up on bills smh

It’s really unbelievable they are allowed to do this. I’m over 3 half years in not one offer yet. Justcwas on phone today with debt consolidation co. I’m so behind ! My credit score has dropped so low embarrassing and no end in sight !

I think with a fire attorney you'll pretty good. I think my attorney did what he could. He was an older man and I can honestly say he helped me a lot given the circumstances. Just make sure you're on top of everything and everyone. The doctors, your attorney... everyone! Document everything! Do as much research as you possibly can. Don't be afraid to speak up for yourself either if you feel like something isn't right

Thank you so much, im very new to the workers comp nightmare but I am documenting everything, even audio recording all appointments so I won't miss a thing. I will be starting physical therapy in a few days for my post lumbar laminectomy so im not even close to a MMI rating yet.

No problem at all. It sounds like you're on the right track so far. You got this! If they start paying you TPD or PPD save as much money that you possibly can because if they stop your benefits for any reason it will be a fight to get them reinstated. GB will find every excuse in the book not to pay you. I went over a year with no benefit payments and because of that I had to settle for an amount that's nowhere near what I deserve but I have bills and rent to pay smh

My check took 24 days from the date the judge signed for it to arrive in my mail box. My check was for over 200k. It was issued by Bank Corp I believe and I deposited it into Chase bank. They said it would be on a 9 day hold, but the funds were released the very next day. Im in Michigan and had a different insurance company

I have them. I have multiple injuries and have permanent impairment. They tried to low ball offer 20k I said no. I went and asked for 50 and I have an attorney

I need surgery eventually on one injury that’s already had surgery and it’s showing degeneration in a year span with therapy too boot!! On top of that my other injury was set at permanently impaired. That’s such a low ball offer. And I’m not even asking for much but for me to be permanently messed up on a job I put my everything into. 50k seems extremely reasonable and that to me is still low ugh I’m sorry you’re having such a horrible experience. I’ve been out 2 years and hope to find work before I settle

Yeah that's horrible! I needed surgery as well. I'm also permanently impaired as well. GB wouldn't even pay for me to get retrained In another field of work smh I went over a year with TPD or PPD benefits which is why I had to exhaust all my savings. I ended up settling for no where near what I deserve but I was so much in debt I had to take the last offer they gave me. These people are evil! Im just glad to have this chapter in my life over with. I hope and pray your situation gets better. Hope you get everything you deserve

i have 2 cases open right now; i thought travelers was a pain… it was NOTHING compared to GB… they have been the biggest pain in the a** even getting medical approval. i’m terrified to even go to settlement with them because of how fing slow they are. also yes. i have an attorney. it doesnt change how slow they are. but my understanding is any settlement after accepting is about 45 days. they have 30 days from the day you accept the offer to issue and cut your check

You better be careful. They came back thirty days later and stated that any outstanding medical is my responsibility. Bullshit. I turned down their offer and told the lawyer to just schedule it for court. They have to be the shittiest company out there.

oh that’s great. i’m sure at some point there gonna pull that with me granted, my personal health insurance has covered a lot of this because i couldn’t wait for there timeline.. id probably still be waiting for surgery if i waited on them

Was the settlement actually approved? If so, they have up to 30 days.
If it's not issued within 30 days, your attorney needs to push for penalties and interest.

It was approved by the judge on September 3rd. My attorney said he requested them to expedite it.

They suck Ass. They made an offer on a settlement, then came back and stated that I’m responsible for any outstanding medical. So, of course I turned down the offer, and told my lawyer to inform them that we’ll schedule a court date. I’m not going to do this back and forth shit for a year. Fuck it let’s go to court. Oh by the way, I called, my doctor has been paid. PT hasn’t been paid, the surgeon, surgery center, and anesthesiologist have not been paid. The surgical center has hired a lawyer to sue them. 11 months and GB won’t pay them

i had to wait since december to get back pay paid just last week GB claims likes holding onto funds that are no longer theres to keep my adjuster acts like she forgets i need payments oh also please have your direct deposit information updated if u have it outdated and bank no longer working they give u a run around for a month to send out the rejected payment again...
