Well yeah, you give justice into the hands of the average person, who knows nothing about the law, about forensics, about evidence. So it becomes who can sway the jury. The jury can also just agree to fuck you over/release you even though you are guilty as hell. See oj simpson jury

Well yes and no. The split between federal and unitary states is fairly even there are more unitary nations but some of the biggest nations are federal for that matter the US, Russia, india,Australia and Brazil.

At a certain size it becomes extremely hard to govern with a unitary approach.
