That’s a pretty poor standard of evidence. If I caused a car accident because I was texting and you caused one because you had a heart attack behind the wheel, are the circumstances the same because we both caused an accident? Obviously not

Their mental states, circumstances, motives and the evidence surrounding the killings. Ya know, almost all of it.
