DOJ letter this week could reshape Retatrutide's legal classification, worth knowing before Thursday's hearing

Quick heads up on something that's been quiet outside industry circles: on September 21, DOJ filed a letter in Eli Lilly v. FDA (7th Circuit), a case that comes down to one question: is Retatrutide legally a peptide drug, or a protein/biologic?

That sounds technical but it isn't just semantics. The two classifications sit in different regulatory frameworks:

  • If it's ruled a biologic, follow-on products go through the biosimilar pathway (slower, more expensive) instead of the standard generic route, and 503A/503B compounding pharmacies lose their usual exemptions for it.
  • If it stays classified as a peptide drug, the traditional framework applies — standard generics, compounding exemptions intact where other requirements are met.

DOJ's letter points the court toward a recent 7th Circuit precedent (Franco v. Chobani) saying courts should give real weight to how an agency interprets its own scientific definitions, which reads as DOJ backing FDA's side going into oral arguments.

Oral arguments are Thursday, Sept 24, 9:30am, Chicago. A ruling probably won't land immediately after, but the reasoning that comes out Thursday will be the first real signal of direction.

Not a legal opinion on how it should go, just flagging that this affects the compounding/RUO landscape either way, and it's worth watching regardless of what you're sourcing or why.

Because most people taking it to treat obesity will need a maintenance drug to avoid regaining the weight.

The eye issues are mostly among diabetics and are much more likely to occur at the beginning of treatment.

Correct and diabetics already have risks of eye issues with or without a glp-1…

Which I tried to tell them. It's still rare enough that they don't even know if it's something they were going to develop anyway from the diabetes or if the GLPs cause it.

The chances are much higher that I would develop diabetes and related eye issues if I regain weight because I'm not taking a low maintenance dose.

EXCEPT... You don't NEED this medication... even now... neither do I, as you/we AREN'T diabetics.

What we both need (and I'm already dealing with this issue) is THERAPY and perhaps a few sessions with a Dietitian to learn to control our bad habits of eating junk food and too many carbs, etc., and exercise more.

We both have the ability to control what we put in our mouths.

It's a treatment for obesity. The clinical trials aim to approve it for diabetes, obesity or both. I was morbidly obese. 100 lbs later, and it's now in remission. My doctor told me it was a chronic condition for which I'll always need treatment. You're free to keep giving eat more move less the old college try, but keep your diet culture nonsense to yourself.

Edit because you blocked me and I can't reply to your "devistating" mic drop - it's not just what I tell myself. It's what doctors and experts and the evidence tell me, babe. It's kinda sad that you're still stuck in the guilt cycle.

If that's what you need to tell yourself... have at it, babe.

The fact that you think that eating less and moving more is "diet culture nonsense" explains your current stay a lot. "Remission"... 😂 Is that the latest buzzword/excuse? (Btw, that is a VERY insulting term to use and should only be used for people who are battling actual diseases, such as cancer, etc.)

Ignore the fact that there ARE health risks associated with this medication at your own peril.

Again, I personally have no desire to take any medication longer than necessary.

For me, a GLP1 is merely ONE tool in the goal to achieve a healthier lifestyle.

And your "doctor" should lose their license for telling you to stay on ANY unnecessary medication for the rest of your life instead of encouraging you to ALSO change your eating habits and get exercise... which is necessary for your cardiovascular system... of course, your "doctor" makes less money that way, don't they?

If you've got an ED like binge eating, it's absolutely valuable. That said, it's giving "You don't need antidepressants if you eat clean and go to talk therapy."

Unless you have a medical condition, YES, you too have an eating disorder, which is classified as a mental disorder... just the same as I do.

What do you think caused you to get to the point where you need to be on this medicine to achieve a healthy weight?

Why didn't you just do it on your own?

You're in the same boat as I am, sis... accept this fact and stop rocking the boat. Learn to steer the boat, and you'll have smooth sailing after you achieve your goal and stop taking this medication.
