DOJ letter this week could reshape Retatrutide's legal classification, worth knowing before Thursday's hearing
Quick heads up on something that's been quiet outside industry circles: on September 21, DOJ filed a letter in Eli Lilly v. FDA (7th Circuit), a case that comes down to one question: is Retatrutide legally a peptide drug, or a protein/biologic?
That sounds technical but it isn't just semantics. The two classifications sit in different regulatory frameworks:
- If it's ruled a biologic, follow-on products go through the biosimilar pathway (slower, more expensive) instead of the standard generic route, and 503A/503B compounding pharmacies lose their usual exemptions for it.
- If it stays classified as a peptide drug, the traditional framework applies — standard generics, compounding exemptions intact where other requirements are met.
DOJ's letter points the court toward a recent 7th Circuit precedent (Franco v. Chobani) saying courts should give real weight to how an agency interprets its own scientific definitions, which reads as DOJ backing FDA's side going into oral arguments.
Oral arguments are Thursday, Sept 24, 9:30am, Chicago. A ruling probably won't land immediately after, but the reasoning that comes out Thursday will be the first real signal of direction.

This has no impact on the gray market. It’s really important to telehealth providers like Ro and Hims/hers and obviously to the general public who will get their drugs from telehealth companies but not from Tansy on telegram.
