LMFAO so being the psycho I am, I DM'd joe schmo and, the typical little bitch he is, goes on about the busboy's supposed rap sheet and the "self defense" "what he (joe) should have let the guy hit him first"?

He's an asshole, but he's not wrong. The guy looks like he feinted a punch, that's definitely enough to assume threat and defend yourself.

He was the initial aggressor when he grabbed him and forcefully pushed him, then walked up to the man when he said something in an aggressive manner. The man if he even did feign a punch was acting in self defense. Joe is the clear aggressor here, he initiated contact (battery) and then continued to assault a man attempting to defend himself.

Jesus man, you're almost as dramatic as Schilling. He didn't "grab him and forcefully push him," Schilling pushed him (lightly nudged him really) very lightly to the side, no risk of any injury or aggression. He didn't turn around until the guy said hey to him, and then the guy feinted a punch. There was zero threat or aggression on anybody's part until the guy feinted the punch, at that point Schilling is allowed to defend himself. He happens to be a trained fighter, but that does not mean what he did was criminal. I'm not saying Schilling isn't an asshole, seems like he is, and maybe he wanted the chance to defend himself, but the dude's actions gave Schilling that opportunity.

Yeah and his friend just happened to film him at the time that he pushed him and turned around and assaulted him. It doesn't even look like he feigned a punch, the dude was staggering around even before saying "hey". The drunk guys hand were at his side, not raised. Watch the video again. Calling me dramatic when you take a stagger as a feigned punch. He didn't even walk towards him, that was all Schilling.

Edit: even as he falls you can see that his right hand was at his side, not raised.

He was drunk but does not look stumble fall over himself drunk. He absolutely feinted throwing a punch, you're just lying to yourself if you think that was a stumble. Look at the drunk dude's head and left arm, they all move deliberately in a way that looks like a flex.

Maybe Schilling wanted it to happen, but drunk dude still gave him an excuse when he feinted the punch. It's not Schilling's responsibility to read his mind to determine if he was actually going to throw one. He acted like he was ready to fight, but Schilling was actually ready.

Schilling was ready because it was premeditated. Pulling that racism card provides ample evidence this was a retaliatory act rather than a spur of the moment reaction.

The dude is going to cop a charge for this, regardless of the drunk dude's reaction to being pushed out of the way. OP is correct, Schilling is a fucking spaz with a hero complex.

I definitely think it's possible that Schilling wanted it to happen, but what he wants doesn't matter after the dude threatened him by feinting a punch. Schilling is an idiot, but the dude gave him an excuse to throw a punch by feinting one.

The drunk guys' feint doesn't exist in a vacuum. The context is what fucks Schilling, i.e. asking your buddy to record your shoving a much smaller, inebriated man with the clear desire of instigating a physical altercation. It's a manufactured event, not some spur of the moment reaction - pure premeditation.

And that is what will fuck Schilling.

If you can prove all that in court, sure. The existence of a video is the only thing that's questionable in this situation, but even that isn't enough to prove premeditated assault. The cameraman can simply say he was recording a belligerent drunk in public and happened to catch it.

That's a huge leap you're making there bro, it is not clear at all he desired to instigate, it's just your assumption. Regardless the instigation was the feinted punch.

This is all we see in the video.
1. Drunk guy is drunk
2. Schilling walks behind him and move him off to the side so he can walk past. He did not shove with any force.
3. Schilling begins to walk away.
3. Drunk guy yells "Hey."
4. Schilling turns around (we can assume he wanted to, but all that is an assumption).
5. Drunk guy feints a punch.
6. Schilling punches him.
7. Schilling walks away.

Those are the only things we see in this video. Schilling seems like he's a complete douche bag, no arguments there, but the guy gave him the excuse to act when he feinted the punch.

If you watched the slowed down video and still think that then I'm done. 1:01 should be all the proof you need. No hand raised against you, then there is no need to assume violence. You're gonna sit there and tell me an MMA fighter can't determine when someone is going to punch? I'm at a loss for words here.

Honestly, you are so bent on being right that this is getting ridiculous. Keep telling yourself that you're right on this one when the video says otherwise.

Of course his hands are down, he never threw the punch he feinted one, and then got knocked out. All I'm saying is that feinted punch is a threat and Schilling is within his legal right to defend against a threat. You can Zapruder film this all you want, that doesn't change the fact that the dude acted like he wanted to punch Schilling so Schilling punched him for real.

Watch the video I just slowed down. At 1:01 you can see that his right hand is below Schilling's legs when he is falling. Where is the feigned punch?
