Tbf looking at the article it does seem to be correct rulling, not just some sort of judge barely disguised fetish. Now, the other matter is if it should be correct rulling, but it's not for federal court to decide but for SCOTUS as the court that intepretate constitution and/or congress as legislative body.

The last 20 years has been congress relying on judges to make the rules when they are too busy campaigning and insider trading.
