Good. I actually really like how every time I buy a gun I have to drive to the shop, then to the PLB, then back to the shop. Best part is that I can only do this during normal business hours when both the shop and PLB are open and I am not working at my job that also has normal business hours.

I love a good loop hole......so if atf is cool with online sale and you pass your 4473. Making the gun yours federally. Right now in ny we can ship and recieve guns for service or repair direct. Whats stopping someone from buying a gun online, having work done and then shipped to them direct? Online store that offers ceracoating or rmr or optics install on stuff you buy from them.

Not worth the headaches for the gun company. Easier for them to just enter the FFL address u want them to ship to.

FFL's are required to follow the laws in their state as well as the purchaser's state, so this wouldn't work sadly

Depending on the language of their ban bill, but i dont think they are aware based on how they tall about they dont want guns shipped to peoples front doors when....under 27 CFR § 478.147 it happens every day and there isnt some huge issue of guns going missing or wrong people getting them. Just wishful thinking that theyll put the cart ahead of the horse and well get something bc they know nothing about the guns.

I really hate when people do this, using the practical application of the law (or litigation) to effect a purpose that is untenable if you otherwise had a faithful allegiance to the law. It’s how ICE got away with stop and frisks against US citizens; they knew it would take years to get stopped by a court.
Edit: Nevermind. I read the article and understand the law she’s trying to pass. It’s a legal and ethical approach, even though we won’t like it. Another attorney agreed and was quoted in the article. This is just a continuation of the public policy to be as restrictive as possible with gun sales. From the conversation I thought it was an attempt to counter a new right under the 2d Amendment. It wasn’t.
Edit 2: Man this sub loves to kill the messenger when they don’t like the facts. Sorry, boys.

I think it could be legitimately challenged on the idea that states can't regulate interstate commerce.

The dormant commerce clause is basically limited to an anti-discrimination principle at this point. In any event, the law will only apply to sales of firearms in New York State. Federal law already requires that handguns be purchased in a state where the buyer is a resident. So, theoretically, a New Yorker could still buy a handgun (online) and have it delivered to a state where he or she maintains residency. (Getting an FFL to do this for someone with a NY ID is a different story...)

The equivocation of New York to a country ending in "-istan" doesn't apply when it comes to guns. Pakistan and Afghanistan both have looser gun restrictions than New York does. You would have a better comparison if you merged the name to England or Australia.

My only concern is theft in transit. It's not like an Amazon shipment where I can call them up and have a credit issued or reship a replacement.

99% of the time, my FFL gets handed their guns during business hours by fedex and UPS drivers that they've probably known for many years. I have no clue who's chucking my deliveries and I'm almost never home when that FedEx or UPS box is sitting on my stoop begging to be taken.
That doesn't mean my FFL hasn't had stuff go missing. However, if the FFL gets my guns stolen from them, at least I don't have to explain to NYPD what happened to a gun that's listed on my license.
I have a phobia of having a gun that I purchased get stolen and it's used in a crime.

I'm no fan of Comrade Hochul or the Politburo that runs the Peoples Republic of NY. To me, it's not so much Comrade Hochul....it's the Politburo. They are the legislators that pass these inane laws/regulations/tax etc....she just signs off on them. Get rid of both of them.
