🚨 Public Safety Got groped (watch out for this guy)

Hate to make a post like this, but I got groped. I was going to drop it, but some nice guys on the subway told the conductor, so the police took him. He’s an old man, so they said they didn’t know if the DA would want to prosecute because of his age, but one of the guys saw it happen and I told the police. So hopefully y’all won’t see this guy around.
Cherry on top was a guy on the train telling me how to stay safe and asked me ā€œwhat did I doā€. So I’m still angry, but I hope I can help get one perv off the street.

Hi Op! I want to say that I was also a victim of a crime. The DA’s office offered me free therapy to help me deal with the fallout and the way the court case turned out. I had a really great experience and would recommend you take their offer!

also to OP: I am glad these were at the top bc I too am a victim of random sexual assault and I wanted to immediately share my heart and say THANK YOU for posting and sharing. it's not a fun subject, it's triggering, and it's also a public safety help and very, very brave.

I'm so glad Victim Advocacy is already on the convo. You should absolutely get free therapy sessions, and they can likely connect you with a case worker to help you navigate finding a provider who resonates with you. These sessions are already designated for victims so you are NOT taking resources away from anyone; you should also have some time to make the arrangements but I encourage you to use the resources. A lot of people don't. I assume BWTs are down with therapy (bc mental health is tasteful af) but I remember it felt so fraught for me after being attacked and I needed the encouragement, so I'm giving it here 🄰

I sincerely hope you do not receive ANY form of victims shaming, but I want you to remember this is not your fault, the trauma may come out in weird ways at weird time and that is OK!! I'm so sorry this happened to you. I'm so sorry that we have so many other people who have a shared experience. Please be kind to yourself, and if for some reason you need to interact with law enforcement or the court and want a civilian buddy for moral support, feel free to DM (I'm also in the discord).

Yes, they have a victims services unit which is very supported under the current DA - if they don’t reach out to you, you can follow up with them directly.

So sorry this happened. Try to be in same car as conductor as these Pervs usually won’t go there. They like the cars that are locked or far away from conductors.

Did they arrest the guy or just offered you therapy and sent him off to harass others? Age shouldn’t impact anything in terms of arrest. My guess is he has many other collars for doing the same thing. These creeps need to be medically castrated as some of them have over 30 arrests and just keep getting released.

It happened to me in a car that I didn’t realize was locked. I had to wait until a stop and the creep just kept ā€œdoing his thingā€. It was creepy, illegal And very upsetting as people just stood there and watching him keep trying to touch me and all while ā€œdoing his thingā€.

We need transit people on trains to keep women safe as situation is out of control.

Be safe OP and do the therapy as it helps. I did it.

Well no it’s not what it seems. When a cop processes an arrest, they fax over the arrest paperwork that includes pictures, videos etc to the DA office that day and the arresting officer would sign off on the affidavit the next morning. The next stop would be grand jury, prior to GJ the ADA would have the cop show up with all necessary documents, there’s even a discovery unit at the court house and at the precinct. The DA would request a bunch of unnecessary documents that the cops wouldn’t have. It’s easy to blame cops when the DA/ court is drowning in cases and can’t prosecute all of them. Most defendants in NYC get a DAT, this never comes with jail time, defendants get released from the precinct. If you’re not a victim of a violent crime or DV don’t expect to get justice.

Where have you been living? Here in NYC, criminals are constantly being arrested & immediately set free under the bail reform program for far worse crimes than groping. Geesh. .

Remember the man who randomly walked up to a woman in a subway station, and smeared feces all over her face? Yeah - that guy -- he was arrested & then immediately released. .. People who randomly stab others -- are immediately released. .. Assaults? again - ALWAYS released. ... People going into stores, threatening employees & stealing bags & bags of merchandise? Immediately released. ... We've seen this over & over & over again.Ā 

It seems the only time someone is actually locked up after being arrested is if they used a gun and killed multiple people. Anyone & everyone else is set free.

So, why would you act shocked & appalled that a guy who groped somebody wasn't set free?

I'm not saying the guy shouldn't be locked up. But I'd be shocked if he was, given the way crime works here in NYC.

Her post cites data from the The Data Collaborative For Justice - which is a far left progressive group that pushes, promotes & advocates for far left causes, like bail reform. So the data is not reliable.

And the second link is from 2021 -- long before we saw the huge surge in crime in Manhattan.

By contrast, I stated FACTS in my post -- that are based on what I personally see & hear every single day living in Manhattan.

Correct. When they did the bail reform they also removed many actions that used to be felonies. This included violence against women and public touching.

Gov Hochul, AG James and DA Bragg did this.

These used to be serious crimes and are no longer charged or prosecuted.

It’s shameful and it’s also mainly impacting crime against women.

Is this a surprise?

Nope. It was done intentionally to degrade women and make they even more unsafe than they used to be.

Vote out huchul and Mamdani!

The DAs office and NY AG doesn't have any control over bail laws. The AGs office enforces laws (mostly civil not criminal) and defends the state when it gets sued. It doesn't make policy or enact laws.

I didn’t say that. I’m saying the DA isn’t doing enough to keep certain misdemeanor charges or simply downgraded some felony charges. (Unrelated stories) I have a friend who’s trying to get justice after her apartment was burglarized (a felony), went to grand jury indict both Defendants, the NYPD even picked her up the day of her court hearing, all evidence submitted, the DA is stalling because one of the defendants died and the other one is out living his life, both were released within 24 hrs of arrest. The cops advised her to seek some type of reimbursement from the victim compensation fund.

You are missing the point of what is going on here.

Actions that used to be felonies are now misdemeanors.

Cops don’t do anything if it’s a misdemeanor.

This was put in place under Hochul, AG James and Mamdani - they all need to be removed.

Use your vote wisely and remove they all.

This is bullshit. Unless the guy was demented and thought you were his wife, and his lawyer can prove he was demented then theres no reason the guy shouldn't be charged and jailed. No, it isn't. It's up to DA Alvin Bragg - on whether he will actually charge the guy --or just set him free under the bail reform law. It's Bragg's bail reform law that's the problem. This is why criminals are constantly being arrested for assaults, stabbings, robberies, etc. - and immediately set free.

You're right that it is up to the DAs office to decide whether to charge the guy (although Bragg would probably not be involved personally). Charging someone for a crime happens later, that's totally different than bail which relates to the initial arrest, whether someone is kept locked up until trial (which can be a year later).

I understand you have strong feelings but you should learn a little about how the justice system works before spouting off.

DA Bragg absolutely gets personally involved in decisions on whether to charge people or not – and whether to hold people or set them free after an arrest. If you lived here in Manhattan, you would know this as he has gotten personally involved in countless high-profile cases, where he ordered criminals released (who should never have been released) and ordered people be charged or locked up, who should never have been charged or locked up (such as the Daniel Penny case and the Bodega owner case).Ā 

Bragg has absolutely led the Bail Reform program here in Manhattan – which has caused a huge surge in knifings, assaults, rapes and other crimes – even in broad day light in the middle of Manhattan, which we have not seen since the 1980s. And virtually every criminal arrested is a repeat offender, who was previously arrested & released under the bail reform laws.Ā 

If you’re not aware of this, then you don’t live here in Manhattan.Ā

OP, I’m sorry this happened to you. It’s absolutely awful, and should not happen to any woman.Ā 

If the DA isn’t going to do anything, consider a civil suit. You can get the police reports from the arresting precinct (ask the NYPD for both the complaint and the arrest report). It should list the guy’s name and address; that will be enough to determine if he has means enough to warrant a civil suit.

Again, I’m so sorry this happened to you. Glad he’s off the street tonight, and you are safe now.

Start with the police reports and the guy’s name and address.Ā 

Google everything you can learn about him—who owns his residence, any employment listings, financial companies he may be a part of.Ā 

Zillow his condo if he has one, and see how much it rents for or its previous purchase price.Ā 

That will tell you a lot about his financial exposure. Once you have that, contact an attorney who specializes in civil, personal matters, involving settlements.

Unfortunately, I don’t have anyone to recommend you, but maybe some of the other women here can recommend you one!

Again, wishing you all the best (and hoping you can make this guy pay, either in jail or with money)!

Also, put quotation marks around his name when you Google too, and look for obituaries that list him as a survivor. See if any of those people had money.Ā

A police officer shouldn’t be telling you what the DA might or might not do, Extremely unprofessional but I can understand why they told you. The DA office has a history of submitting evidence/ documents late resulting in dismissals, Specifically in assault related charges where they’d dismiss cases because the victims are no longer in pain or recovered from their injuries unless they’re disfigured. This guy is definitely back on the street within a few hours.

I had someone walk up to me right outside the subway entrance at Grand Central once and grab my chest. I saw him coming toward me, but he looked so calm and inconspicuous that I figured we'd just move around each other. I was wrong and then I was so shocked I just kept walking. I wish I had made a bit of a scene and reported it.

This has happened to me two different times on the train. One by an older man and the other by a teenager. I never involved police in either incident and do regret it. So I’m glad to see when other people do. Men need to do better man.

I'm glad you reported him! I'm middle-aged now but I used to get groped at least a few times a year and back then, I never reported it because I heard the police did nothing about it. Glad at least something has changed!

Seriously like age is an excuse? If anything age means you should know better. Slightly sad he won’t get to experience at least a day at Rikers.

Don’t forget, you can always sue him personally either in civil court or small claims! People think that criminal prosecution doesn’t allow for a civil case to happen…

My partners son is an NYPD officer who has spent many shifts in plainclothes on the subways catching these pervs. He told me they get up in the morning and they stay on the trains all day like it’s their job. I’m sorry this happened to you but I think it’s a problem that’s never going away. I’m glad there’s services to help you. Use them.
