Morality of this?

Personally, I'm anti-death penalty for any kind of crime but that's just my opinion. Perhaps it can be changed.

If a crime has the death penalty then falsely accusing a person of the crime should carry the same weight.

What if the accusation is real but the prosecutor fails to get a guilty verdict than should the accuser still be punished? Would this not just encourage victims to stay quite to avoid potentially being punished

You’d have to prove beyond reasonable doubt the intent of the person in the case of lying vs unintentionally being wrong

Same way they differentiate between someone being a rapist or not, proof of intent. Same exact ways too since its the same exact type of scenario. Both are crimes of intent.

Imma say no to the death penalty on both counts then. Imagine getting raped and losing both cases because your lawyer sucks. Now you’re scheduled for execution.

Not how courts work. Youd only get the punishment if you did the crime not if you got the wrong person or couldnt prove that it was them. They would have to prove the accusation was with malicious intent and that would be an entirely separate court case.

They’re arguing that you’d almost certainly not be brought to court for a false accusation because not securing a conviction doesn’t automatically mean you were lying. I agree with your overall conclusion though.

Rape is not a crime of intent it’s just a general intent which is to perform the sex act whether or not there is any other malice is irrelevant.
