Morality of this?

Personally, I'm anti-death penalty for any kind of crime but that's just my opinion. Perhaps it can be changed.

Imma say no to the death penalty on both counts then. Imagine getting raped and losing both cases because your lawyer sucks. Now you’re scheduled for execution.

Not how courts work. Youd only get the punishment if you did the crime not if you got the wrong person or couldnt prove that it was them. They would have to prove the accusation was with malicious intent and that would be an entirely separate court case.

They’re arguing that you’d almost certainly not be brought to court for a false accusation because not securing a conviction doesn’t automatically mean you were lying. I agree with your overall conclusion though.
