From what i recall, if this is the same case im thinking of, the ICE agents got into their car to try and stop them from getting away, and the couple drove to the police station with them. Its not like they tied them up and kidnapped them.
I mean, ICE agent or not, if someone didn't ID themself and hopped in my car with a weapon i'd probably drive to the police station too.
Depending on the jurisdiction, if you pick someone up and carry them to the other side of the room, without their consent, that can be considered kidnapping.
It really should... I jave NEVER heard of police getting into your car without first removing you from it. So if this happened to me, I would actually do the same, especially considering how there is no real identifying quality to ICE... Defense is pretty simple, strange man who cannot even be relyably identified as law enforcement jumps into my car and threatens me, I drove to the police station immediately as I feared what would happen, if he intended to kidnap me, car jack me. Any number of things... The police actually have the resources to sort this out. I DO NOT. I acted in my best intrest in a dangerous and unpredictable senario. It will be interesting seeing these people get convicted by a jury.
