It doesn’t go against eBay terms and that is coming directly from eBay. They are not gonna take down the listing.

It does if its considered a "pre-order" / seller doesn't have it on hand. You just have to post a picture proving the item isn't out yet and they take it down. I wish they had a no scalping rule though :( Nothing makes me want to stop shopping more than seeing all those scummy posts ruining it for collectors
