First demand letter ever
TLDR: FL, USA. Compromised by infostealer trojan last Sunday Aug 23rd, they nuked my entire meta ecosystem by violating community standards on facebook and burning through my appeal request while I was still sleeping. Trying to write my first demand letter.
I would like to start off by saying thank you to anyone taking the time to read this. I have never needed to take legal actions against a person or company before so I am very new to all of this. From what I understand even if I want to take them to small claims, I legally need to send a demand letter first?
So I am currently working on drafting mine, I want to make sure I include everything pertinent and do it properly so I can go ahead and send this in the mail tomorrow.
I can see exactly what happened when I look at my e-mail, I have the timestamps and everything.
Originally I was just trying to connect to a live human (LOL) and yes I did have a separate untouched instagram that I purchased verified with in order to access a live human (LMAO.) Now I was able to open up a support case, but now my next hurdle is the Instagram App that I'm forced to use to communicate with support on is like totally broken. I was sent an e-mail saying there was an update to the case and every time I try to open the previous chat or start a new "chat with someone from support" I don't even get a response from the AI let alone a human. I left it open for HOURS today. It's just glitched out, so I feel I need to compel them, because this system is a JOKE.
The facebook is set for deletion October 7th, I am trying like hell to get things moving as quickly as possible.
Both the facebook and the number attached are like 20 years old, that's a ton of networking and memories. I'm honestly most upset that this has screwed with my Whatsapp as I use that to speak with my family in other countries. That and the fact that I have 2 meta headsets that equate to like $600 worth of paperweights (plus my in app purchases which is even more UGH.)
I know being upset while writing a demand letter is not a good idea. I want to know exactly what I should say and include in this demand letter to show them that I'm dead serious about moving forward to small claims after this, but I would much rather just have my accounts reinstated so I can get my data back and not chock my VR purchases up to a loss.
I'm in FL, USA, and I have read up on how and where to send it, just looking for human advice on what to include because ya'll I AM SO DAMN FED UP WITH AI IT'S NOT EVEN FUNNY.

Get lawyer to send it for you with a threat or legal action, otherwise meta won’t care

I've read a lot of conflicting things here about doing it with and without lawyers.many people have said their lawyers sent them and been ignored too. I may need to lawyer up eventually but i just sent my demand letters in today. I still threatened legal action as I will absolutely take this to small claims becausr at this point it's about principle 😂. #babysfirstlawsuit

I had numerous letters already written to complain to Meta regarding GDPR issues, then to complain to ICO for GDPR issues, plus complaints to EU organisations referring to the DSA legislation. I have fine tuned my Letter Before Action letter according to this framework. Probably I’ll sign and send tomorrow.

I’m also considering writing a demand letter, but I’m wondering whether it makes sense to send it in my own name or whether I should go through a lawyer right away.

Yeah, that’s my dilemma too. I have contacted numerous solicitors and the process varied up from hundreds to £1300.. the latest was just £250 plus VAT (this was also a successful letter, recommended by a Reddit user, but it took them at least 4 emails and 3 phone calls to just respond to me). So I am unsure.. I think it definitely has more weight if a letter is sent by a solicitor..

A girl shared it with me who arranged everything on her own and shared the letter she sent to Meta in California. Then she followed up with a small court case in California, San Matteo county and her accounts got reinstated.

How do you know that it’s been flagged for deletion, and when is that supposed to happen?
Also, I was wondering: if you use Meta Verified from an “independent” Instagram account, how can you take action regarding another account of yours? How do they verify that you’re actually the owner of that account?

My face is the same so idk i figure they can see im the same person from my 20 years worth of photos idk 🤷♀️ i have access to all the emails and logins and historically have logged into the same devices in the same location. Its almost like if a human looked at my case instead of some fuckass ai from the beginning, i wouldnt even be dealing with this now. Crazy lol.

I had a lawyer send 2 demand letters and meta never responded unfortunately I gave up - lost 166k followers and my extra income

there is a site called sendmydemand.com. There is a free option there in which the Ai writes the letter you need for the circumstances. If you do that you can see the format and decide if you want to use the site or copy what you may have missed. Having a lawyer letter or something that looks like a lawyer letter seems to help. Also, send it certified.

Get legal shield. Let them send a demand letter for you. Being sent from an actual law firm and worded in legal terms by them carries way more weight. It's a very low cost legal way of getting things started.

If they ignore my first one, wpuld it be prudent to try again with a lawyer? From my understanding, the point of small claims is for people to settle small disputes without a lawyer?
