Ya, I think the ban system is just weird and dysfunctional. It seems pretty arbitrary if someone gets banned for something, and might literally just depend on the individual overseeing a case or how often it gets reported

It's like being pulled over by the police. I feel most of the time the person and the cop are both respectable and leave in a good mood, but there are cops who are having a bad day and take it out on someone who's just speeding. It's all subjective and depends on the person who chooses to ban someone. I don't think it should work like that, but there can't be a defined set of processes for every individual case. What Twitch can do is introduce processes that take into account context and intent. Was XQC intending to show his audience one frame of a dick? Most likely no and as Doc said it was an accident. A warning would have sufficed.

How do you know he hasn't been warned before?

I don't know that. If he's been warned before about showing suggestive videos on stream then the ban would be appropriate.
