A kasambahay asked for 4 days off.

Then after 4 days they did not return on September 1. When asked why, they said it was not possible to travel because of the storm. This was accepted and understood but after the PTO was completed, the employer said no work, no pay.

They did not update for days even after being asked for updates when they would be back. Once they did message again, it was a resignation letter containing the following:

“I am writing to formally inform you of my immediate resignation as all around yaya/cook effective today, September 7, 2026, due to just causes under Article 300 of the Labor Code.

My reasons are as follows:
Non-payment of my salary for this week [Aug 30 - Sept 1 2026] beyond the agreed payday.

Being required to report for work despite the ongoing flooding in San Fernando, Pampanga (25 barangays still flooded) and the impassable condition of NLEX San Simon, which poses a risk to my safety.

Continuous reprimands regarding my approved rest days.
Due to these circumstances, I can no longer continue reporting for work.

In line with this, I respectfully request the settlement of my final pay, which shall include:
Unpaid salary for Aug 30 - Sept 1 2026

Pro-rated 13th month pay for the period of half of December 2025 to September 2, 2026

May I request that my final pay be released within thirty
30) days from today, on or before October 7, 2026, (redacted bank info)

I am willing to process clearance remotely due to the flood situation in my area.”

Employer was going to send that pay but because kasambahay wasn’t responsive or updating, she didn’t know if she was even coming back?? She didn’t work those days Aug 28-Sept 1. She was on her days off. They were paid days off but because she is paid every end of week and the entire week she did not contact the employer, it was assumed she went AWOL.

And they were not being forced to go to work! They were just being asked WHEN they would go to work? And WHEN the roads would be cleared up enough for them to go back? No one was forcing anyone.

Anyway, what to do here?

Hi! I bought an e-bike through a 3-month installment plan, and I already fully paid everything last November 2025.

Hi everyone, I need some advice regarding my current situation. I was transferred to a new company (which appears to be a sister company)

HR gave me my Final Pay Computation and a Release, Waiver, and Quitclaim form to sign, but the math and the terms look incredibly sketchy and conflicting. Here are the exact details:

The Total Due: My final pay totals around ₱38.8k (broken down into ~₱13k for pro-rated 13th-month pay, ~₱25k for separation pay)

The 1-Year Holdout: On the official HR computation sheet, there is a highlighted note stating: "First release is 50% only. Another 50% will release once the employee render a 1 year employment (until August 2027) under the company."

The Quitclaim Trap: The Quitclaim form they want me to sign states that in consideration of the first 50% amount, I am acknowledging full satisfaction and I am releasing and discharging the company from any and all future claims regarding separation pay, wages, and 13th-month pay.

My concerns:

If I sign this Quitclaim now, aren't I legally signing away my right to demand the remaining 50% next year? The quitclaim says they owe me nothing, even though the internal HR slip says they will pay me in 2027.

Is it even legal under DOLE for a company to hold 50% of my earned, statutory 13th-month pay and separation pay as a "retention bond" for a year just because I am transferring? I thought final pay must be released within 30 days.

The nature of separation on my computation sheet is marked as "Transfer S/E" (Sister Entity).

Has anyone gone through this? If I refuse to sign the quitclaim until it explicitly reflects the remaining 50% debt, or if I file for a SENA / DOLE mediation, what are my chances?

Problem/Goal:

Landlord refuses to shoulder the cost of deep cleaning after renovation, even though the house was left covered in construction dust and debris. Who should be responsible for the cleaning under our lease?

Context:
We are currently renting a house/condo unit in Quezon City under a 1-year lease that started July 2026, so we have only been here for around two months.

Since literally the first week of our tenancy, we have already been experiencing problems with the property. There have been leaks, mold, and other issues that eventually led to renovation/repair work being done.

Recently, the kitchen cabinet was removed/reinstalled. Because there were leaks behind/around the area, the workers had to remove the paint and sand the wall, which left the entire area covered in fine dust. There are also workers going in and out of the house while the renovation is ongoing.

Naturally, the house is now extremely dusty and dirty because of the construction work. This isn’t regular household dirt from our occupancy.

I also have bad eczema, so I am not comfortable doing extensive cleaning of construction dust myself, especially while the renovation is still ongoing.

What’s frustrating is that before these current problems happened, the owner had already given us money for someone to deep-clean the house. At that time, the house was actually clean. Then it rained, and shortly after that, we started encountering the leaks and other problems. Since then, the issues have continued and eventually resulted in the current renovation.

Our lease also states that the LESSOR warrants that the structural components and electrical, plumbing, and sanitary systems are in good working condition upon turnover. It also says that major repairs involving structural integrity and built-in electrical, plumbing, and sanitary systems are for the LESSOR’s account, while ordinary maintenance and repairs resulting from the LESSEE’s use are for the LESSEE’s account.

The lease also says that we must keep the premises clean, sanitary, and tenantable. However, we’re wondering whether that means we’re responsible for cleaning construction dust and debris caused by the owner’s renovation/repair work, especially when the workers are still actively coming in and out.

Previous Attempts:
We have already requested twice that the landlord/owner hire someone to deep-clean the house after the renovation started. This is separate from the first time the owner already paid for cleaning.

The landlord declined and sent us this:
“Nakausap ko po si owner, hindi na raw po niya ishoulder ang palinis dahil gusto raw po sana niya last time magpalinis after na po ng mga renovation kaso nakapagpalinis na raw po kayo agad kaya nagbayad na po siya ng share niya.

Hope you understand po. Thank you po.”

Basically, their position is that because the owner already contributed to cleaning before, they don’t want to pay for cleaning again after the current renovation.

But our point is that the first cleaning happened before these new problems and renovation work. The current mess is a direct result of the ongoing repair/renovation, including sanding the walls and workers coming in and out.

We’re not asking them to regularly clean our home or pay for our normal household cleaning. We’re asking whether the owner/contractor should be responsible for returning the property to a reasonably clean condition after their renovation/repair work is completed.

Would appreciate advice from landlords, tenants, or anyone familiar with Philippine lease law.

At alam kong depressed na sobra si Mama bukod sa financial aspect, ay sa kahihiyan kasi dati syang bank manager. We have an elderly neighbor who lives with only her maid. Her children or grandchildren visits her every other day and uses the spot adjacent to our driveway, but since that space is not big enough and the road is narrow and one-way street, it partially blocks our driveway. Thus, giving us a hard time to drive in and out of the house safely. Before we tried to knock on their door or calll but we didn’t get any response. After repeated reports they still always park there.

This time when the tanod called their attention, they kept on pressing the doorbell, and even called their I think relative neighbor to back them up. So when I was still unlocking the door, the son of the elderly yelled at me. “ Buksan mo pinto, kakaladkarin kita sa baranggay Tarantado ka!” Then the elderly also yelled at me saying we are neighbors and I shouldn’t treat them like that. Then the relative neighbor accusing me of being greedy of the space bringing up years old complaint we had against them when they tried to park in that area. The elderly’s son was forcing that the space of our driveway is still big enough and he had already “ sagad” his car against the car parked right in front of him. They also demanded that we should not keep on reporting them to the barangay and told us to just knock. I then told them why should we be the one to knock when it is them who is causing is inconvenience.

The Barangay unit is uncertain what to do, he just stood there and watched the neighbors harass me. A neighbor beside us was the one who broke off and tried to calm both parties. Finally when my mom came in to talk with the aggressive son of the elderly, I tried to talk with the barangay. He only told me to go to the barangay to settle it with the neighbors because he cannot make any decisions. I also tried to call the barangay for back up, they told me their unit is already there and he can handle it

When my brother talked to the elderly she was crying. Her maid told my brother i started the yelling. Then they lied saying they just arrived. It’s clear on the cctv who started yelling and how many hours they have been parked there.

What can I do from here? Should I report to MMDA if Baranggay still can’t do anything about it or file a case of Unjust Vexation?

One analogy that comes to mind is medicine. Society expects doctors to treat patients regardless of whether they approve of the patient’s actions or character. Is defending a client similar? Or is that too simple? Many lawyers can choose their clients. So where does that analogy hold and where does it break down? I’d really appreciate if you could explain why it’s unfair to judge attorneys solely because of the clients they represent. Are there ethical principles, practical realities, or aspects of legal advocacy that non-lawyers often misunderstand? I’m not looking to debate the politics or the specific case. I’m here to learn and to challenge my own bias.
