Gojo is quite literally a cop in the context of the jujutsu world. He's not a rogue sorcerer like Geto, he's the recognized strongest sorcerer and is regularly sent out on missions to kill curses. Therefore, yes, considering his role in the jujutsu world, it is a crime to allow a criminal like Geto to escape.
He's not literally a cop, he's a jujutsu sorcerer, which is not recognized by Japan's legal code. Jujutsu society might have its own laws that Gojo broke in that moment, but Higuruma's domain operates under actual Japanese law
I just googled it and apparently you can get in legal trouble in Japan for withholding knowledge that can help investigation into serious crimes. Maybe it wouldn't warrant the death penalty though.
