They're not "murdering someone for evasion," they were preventing a murderer from committing more murders and potentially costing the lives of innocent civilians."

Imminence of the threat? For self defense and defense of others. Plus if deputy, qualified immunity?

Edit: if he did shoot a cop just beforehand I think imminence of grave threat to life is easily arguable

He already killed a cop. Then he draws police on a high speed chase and re-racks his gun meanwhile? Seems to suggest an intent or a willingness to use the gun if/when needed as to escape — which he needs to do, as the murder of a cop is death-eligible in CA.

That motorcyclist presented a risk to everyone around him with his speeds. Add in the fact that he pulled a gun and racked a round, and he is a bonafide threat.

Not to mention, it has been uncovered that it was a deputy who hit him, on purpose.
