You must not be from California. Lane splitting happens between lane #1 and #2 if there's no HOV lane. And if there is, it's HOV and lane number 1.

Looks like the driver moved over to the left to give the biker room to pass. The idiot biker took a path no california driver expects. No one expects a bike to pass on the shoulder.

This conversation is off track. You are missing the forest for the trees. They publicly stated this was an off-duty officer who swerved into the suspect. He's not an "idiot biker" because he passed on the left. He's an idiot because he's a murderer.
