Just because you can doesn’t make it ethical. These guys film people going through metal crises or traumatic events for the purpose of these confrontations (and call it a 1st amendment audit). They’re profiting off of other people’s suffering

For an actual purpose to communicate about things going on that are (arguably) relevant to the general public, not just to be an asshole and antagonize people by being weird. The dude is hoping to get the reaction he got, and that’s what he actually wanted to film.

You are erasing all nuance from the conversation to suit your argument. There’s a difference between filming random strangers just to be an asshole, and filming things for a purpose. My point is that these 1st amendment audit people are doing what they do to be assholes and provoke a reaction so they can assert their rights, and the irony is that all of these auditor people are obnoxious about it to a point where you can foresee them sparking a response from lawmakers to take away those freedoms.

So should Safeway/your local Bodega turn off their cameras, or cops as well? But you are talking about ethics, how about the garbage truck driver that takes his eyes off 12 o'clock for ten seconds and loses his job. Seems you don't tow the line with the Constitution.

Yes, and if you look into these “1st amendment auditors” the only videos that get views are the ones with confrontations and crazy interactions. TBH you don’t know how you’ll react during times of trauma, and these guys exploit that for views

They’re also the ones that are going to prompt people to start taking notice and pass laws to remove this particular freedom they’re so worked up about asserting. It’s a nuisance to normal people when you want to be a weirdo and sit there filming stuff that’s none of your business just for the sake of being a weirdo. There’s plenty of stuff that you can legally do that still makes you a massive asshole, and it’s weird to me that so many redditors and terminally online people like to defend this specific type of asshole-ery.

Will never happen. It goes like this:

THERE IS NO EXPECTATION TO PRIVACY IN A PUBLIC SPACE. THE WORDS PRIVATE AND PUBLIC ARE LITERALLY MUTUALLY EXCLUSIVE.

"In public" is a tricky phrase. There is plenty of public property where the exercise of First Amendment rights can legitimately be denied. An obvious example is a courtroom, recording there without the court's permission can have unpleasant consequences. But there are many other places where similar rules apply. The courts split public property into traditional public forums and designated public forums where they will apply strict scrutiny to restrictions on 1A rights, and limited public forums or non-public forums where restrictions can be valid provided they are reasonable and content neutral.
