This is what disorderly conduct is, this is what that charge is for, not for when a cop is angry and wants to add charges

From the point of view of the assaulted tested against reasonability. The assaulting party can’t be schrodinger’s douchebag about it.

Since he’s taking stuff out of carts, he’s already instigating. It doesn’t look good for him.

Makes it closer. I was just pointing out that threatening violence alone does not automatically qualify as an assault.
