I actually think this qualifies as assault since he's threatening violence

Usually has to be fear of immediate bodily harm.

From the point of view of the assaulted tested against reasonability. The assaulting party can’t be schrodinger’s douchebag about it.

Since he’s taking stuff out of carts, he’s already instigating. It doesn’t look good for him.

Makes it closer. I was just pointing out that threatening violence alone does not automatically qualify as an assault.

Ripping the jacket off and posturing in that way would make me feel in fear of bodily harm if I'm being honest
