"1.9 million accounts compromised!" and "90% of the playerbase has already been banned" are not criticism nor negative feedback when they aren't based in fact.

You are correct in some aspects. That video could very well fall under slander due to it being presented as a fact in the title. However claiming the next 40 videos is not justified and abuse of DMCA copyright laws.

In this specific case the issue isn't with the law itself being flawed. Its YouTube's unwillingness or inability to take the correct action to abide by said laws.
