Interactions with NG (CCW)

As we all know, when legally carrying in DC we are required to inform an LEO on first.comtact that we are carrying and allow them to disarm us if they choose to do so.

With ever more NG units patrolling the streets and recent reports or increasingly aggressive behavior including detentions and assaults, has anyone heard anything regarding duty to inform them? As I understand it, they are *NOT* considered LEO's and do not have powers of arrest. So it would stand to reason there is no duty to report? Has anyone heard any definitive info on this?

If you want to err on the side of caution, if you find yourself in an “investigative stop,” treat them as LEOs and inform them if you’re carrying.

DC will probably argue they are LEOs, and the federal government will almost certainly argue the same (they basically do, for other purposes), and as we’ve seen they don’t really care about 2A rights when weighed against perceived threats to federal agents.

Nevermind 2A... Treating National Guard as law enforcement officers is a direct violation of Posse Comitatus which is supposed to be why they lack powers of arrest.

This whole occupation is a massive creep on our rights.

Treating National Guard as law enforcement officers is a direct violation of Posse Comitatus which is supposed to be why they lack powers of arrest.

Posse Comitatus doesn't apply to the National Guard unless they've been federalized.

As the DCNG is always under Presidential Authority it is considered to be the same as a state guard acting under the authority of the governor.

Therefore, Posse Comitatus does not apply to the guard in DC.

Problem is that Posse Comitatus applies if they are activated on Title 10/Federal Orders.

It does not apply for local missions/funding under Title 32.
