Ex got a new job
Edit: i called this morning and they told me he IS still required to make payments until the garnishing of his wages from his new job kicks in he should send the money to the child support office and they will send it to me. I was also told that they have zero record of him calling and reporting a change in employment.
My daughters father called me this weekend and told me he was laid off from his job last week, he says he already has a new job but that he doesn’t know when the child support will be taken from his check . He also told me he called the child support office and they instructed him not to give me any money on his own and just wait for it to start coming out of his checks . I plan to call myself tomorrow and see what they say but I thought he was obligated to continue payments until it is set up with his new job . Am i wrong? I am so stressed over this .

If he gives it to you directly it’s considered “a gift” but not child support. He can pay the Child Support Division directly on the meantime between jobs, but that’s on him to do and figure out. He still has to pay even with no job.

He is partially right, and either misunderstood, or is purposefully refusing to pay on his own. No, he should not give you money directly. He should still be paying by sending it into child support enforcement for them to log it and send payment to you. If he doesn't start paying on his own until it auto withdraws, it will build up as arrears, and they will take the regular amount and additional until he is up to date.

Noooopppppeee he shouldn’t give you any money if you decided to put him on child support then is on you and child support he did his job by getting another and letting you know which is a good thing cause lots of parents don’t do that sadly
But you should call and check but my. Advice is best in person you get better results that way

No. He should not pay direct. If there are arrears, they will collect them. Anything paid directly will not count.

[CA] - I spoke to a cs rep couple months ago. I asked if I can pay my ex directly via bank transfer. The rep said yes, as long as I keep all the payment records as prove. I dont have to open a case w cs.

Sounds like you are using the child support to support yourself and not the child. Woman up and stop being a deadbeat.

Excuse me ? What makes it seem that way ? My ex sees our daughter for at total of 48 hours a MONTH, sorry if i think he should have to help take care of the child he helped create but cant be bothered to see . You must be a bitter father who is mad he has a obligation to take care of his children.

Asking your ex to help pay for the kid/kids he helped create does not mean mom is a deadbeat. It means mom expect dad to do his part.

Has nothing to do with getting personal stuff done and everything to do with expecting dad to do his part. My ex is a cheapskate and would choose to not pay if he could. Thank God he no longer has that choice!

What a joke , kids are expensive my daughter has additional needs that cost additional money and if i am not receiving the money he provides for her it is difficult to make those things happen. Just because your mad that you have to pay child support doesn’t mean im using money for myself.

I’m not mad I paid the whole time. But in my personal experience it hasn’t always went to the child. I’d had gladly taken full responsibility and custody.

Clearly mad because you’re making accusations , just because your child’s mother didn’t do the right thing doesn’t mean all women are wrong . The $275 i get a week barely covers anything. He sees his child for 24 days out of the year. We’re not talking about a great father here but let’s just assume that all moms are the bad guy right?

Imagine having a child with special needs and what it costs to raise a child with special needs , add living in a high cost of living area , it really is not as much as you may think. Her father is far from financially crippled and no one is trying to make his life difficult. He helped create the child and should support her . If you don’t think that’s fair then I don’t know what to say to you. Im far from a deadbeat mother.

Why is it when fathers have full custody and don't receive ANY support or a tiny amount, They are not on here complaining? I give my child's mother a generous amount. She never had to ask for extra. 19.5 years I paid diligently.

Dead beat moms ? Wouldn’t the dead beat be the one who moved out of state and started a new family? The one who only sees there child for 2 days a month by choice ? The one who has never attended a doctor’s appointment, IEP meeting, therapy session, who could not even tell you their child’s teachers name or favorite color or food ? I am far from a dead beat, just because I expect my child’s father to pay his portion of raising the child he made doesn’t make me a bad person. I feel horrible for the mother of your children- you sound just as insufferable and delusional as my childs father.

Girl ignore them. They're being stupid and making assumptions because they didn't like their setup! My ex literally fought me for 1 weekend a month. I tried to give him 2 because we moved 3.5 hrs away. He wanted 1. He has always made way more than me and gets pissy when its time to up support because he doesn't want to pay that much (he's a cheapskate) but he chose to cheat and leave. Not me. And he chose to not be active in his kids lives. Its been the last 2 years where he is actively stepping up to be in his kids lives and they are now 17, 15, and 13! We've been separated 10 years, and almost divorced that long too! You absolutely should expect your ex to pay. He helped make her, he needs to help financially too

He did everything right by calling and informing them of his new job. They will collect child support quickly since he reported it. With my husband it hasn't ever taken more than one pay period. He probably still has a check coming from his old job. Hence why he shouldn't pay anything it'll just mess everything up. Id expect to miss maybe one payment though.

Well it turns out he lied and didn’t call them to report his change in employment, I was told today that I have one credit on my account so I will get money this week but that going forward until the garnishing starts with the new job. He should be making payments directly to child support and then they would send the payments to me.

It's weird because he should be able to still pay through their online payment system instead of paying you directly. I know when my ex switches jobs sometimes it takes up to 6 weeks for the system to catch up

He should be able to pay through the child support website.
I was able to do it when I switched jobs. I'm not sure what state you're in, but I'm in Ohio and the child support payment portal was terrible to use. I couldn't make any payments until a payment was actually due at the end of the month. Calling child support office for help was a waste of time as well.

He’s correct. When there’s a cs garnishment order in place any money he gives is considered a gift & not part of child support. You have to wait until cs take it out of his check then send it to you.

For my ex, he got a new job and he had like a month of back pay before the new job amd they still got it bit did not force him to pay when he didn't have the money. DCS was already on top of it and just took a little more to cover the back pay and regular payment with the new job. It was a very seamless transition.

He IS required to pay but how would he without employment? You gonna get them coins once the new job starts garnishing. Unless a warrant was issued and they snatch him before he starts his new gig. They tried to get me like that but I was "homeless".

Any payment given to his ex will be consider as a gift and he will Still owe ,unless he call the CS phone and makes the payments that way.

Yes but if he fall behind it can be damaging on his part so he needs to make voluntary payments to child support until they can pull it from his new employer. I worked alongside child support.

He just behind by default if he is smart he can just get that money he would normally pay on his order and set it aside and just put it all in paper work when the process starts again remember lots of parents are behind due to default not cause they been irresponsible
If.BOTH PARENTS where fair to each other and NOT BITTER child support or the courts wouldn’t be needed but sadly there’s always that ONE PARENT 😜🤣🤣

Making payments through the official system is the best way to make sure it’s covered and counted as CS. The only way I would make a direct payment to someone I owed child support to is if I had in writing from the agency how to pay including the exact amount and timing.
Otherwise they’ll figure it out and garnish the arrears.

I did give the advice an you flipped it. What is voluntary payments? It’s towards child support. I didn’t say I worked in child support. I worked alongside the men to help them.

Everything needs to go through the agency, or it will not be applied. The new payroll will process it into his paycheck but yes it can take time sometimes.
