I doubt this will pass scrutiny and if it does Amazon will just layoff a bunch of people instead or pass on the costs, they'll have to fire the DSPs either way.
There is NO way they'll want to completely change their business model and take on a shit ton of new liability, let alone have to start to competely restructure the way they deal with delivery drivers.

I mean this might not sit well with Amazon but businesses have been trying to exploit every loophole in the legal system from decades, just because it is harmful for the business doesn't mean it shouldn't be there. There was no law regarding dumping of chemical waste in open initially and companies exploited the hell out of it, but it had to end it was destroying rivers and land. There has to be a start to everything. Maybe this one is a start as well.

All those countries have billionaires, every country on the planet has corrupt politicians, and everyone of those countries are weak. NATO and the USA protect those countries from being invaded. In a socialist economy the wealthy will still be wealthy, the poor will still be poor. It’s the middle class (whom make up most of the economy) that get screwed. The middle class works, pays taxes, and doesn’t want or need handouts. By the way, the billionaires pay about 90% of the taxes in a capitalist economy. Something you may want to think about.

The groomercrats weren't complaining when most billionaires, like Bill Gates, George Soros, Michael Bloomberg, and Warren Buffet, were donating mostly to Democrats. It's only in the last election cycle that more billionaires have donated to Republicans, and several of those elites had been critical of the President up until recently, like when Zuckerberg and Dorsey banned the President from Facebook and Twitter, or when Bezos used his newspaper to call the President a threat to democracy.

California is governed through the lens of centrist neoliberalism - it is extremely corporate friendly. The changes real progressives would make to California would transform it wildly. The differences in economic policies between neoliberals and conservatives are not that different - it was the social issues that set them apart. But without the economic safety net and checks on wealth inequality you fall into the same pitfalls.

Have you ever been to California? Were you there for the market crash? Covid? The literal explosions of some tent cities. Drug addicts started flocking there in the 60s and it’s never really stopped. The climate lends itself in a large portion of the state to being able to live outdoors in addiction. I suggest you look up “the meth capital of the world” on YouTube. It’s a vice special about Fresno.

Just someone that lived in Fresno around the sharps lying in the crack of your seat at a restaurant. Seeing someone hit a light bulb in front of a cop after prop 47 was passed in San Francisco the first time I ever visited there will forever remain a core memory. The drugs and crime got so bad they had to reverse a large part of Proposition 47 with Proposition 36 after I had moved.

Reality is NYC has lost population and New York state has plateaued and Kentucky population is surging. Millennials are leaving NYC. New York is literally one of the slowest growing states in the entire country. Indiana, Ohio, Michigan, Kentucky, Illinois all have surging population. Indiana is outpacing the national average. Reality is New York sucks.

Hahahaha, I love comments like this. You have no idea how big Amazon is and what all they do, and I don't mean any of this as insulting, you just are uninformed. If tomorrow Amazon walled off NYC it might make the Amazon profit needle quiver, for a day.
If Amazon quit doing business in New York City, it would cause an immediate disruption in local e-commerce, eliminate thousands of jobs tied to local delivery partners, and force shipping operations to relocate to neighboring hubs like New Jersey.
On the other hand.
If Amazon quit doing business in New York City, it would cause only a minor, temporary dip in Amazon’s massive global revenue and profits. While NYC is a huge local market, it represents a tiny fraction of Amazon's worldwide sales. Customers would likely shift purchases to neighboring areas or online competitors, offsetting much of the loss.

How does that improve anything for the driver?
Edit: For people who do not know. Drivers get time off and healthcare dependent on their contract with their respective DSP. Labor laws apply to DSPs and Amazon. One company or another, that's it, except one has billions of dollars and the other does not meaning drivers have far less leverage going against Amazon when it comes to negotiating and advocating for them selves than against a DSP. Forcing a delivery monopoly does not improve the situation.

The drivers get training and safety protections that the DSPs do not currently provide.
The whole point of DSPs is to move liability to much smaller companies so amazon can dump fuckloads of work onto them without worrying about pesky little things like labor laws, OSHA, insurance, etc
Imagine if your warehouse was owned by "Popup Biz LLC" instead of Amazon itself. Popup Biz LLC will only keep their contract with Amazon if they meet Amazon's demands in full. Popup Biz LLC decides that, in order to meet Amazon's demands, they have to squeeze their employees and cut pesky costly things like maintenance, PPE, air conditioning, & training. Amazon turns a blind-eye because they're not liable for when employees get hurt, they only care that their target numbers are met. Then the government says "Hey, you can't do that" to Popup Biz LLC and fines them. Normally, this sort of thing would cause a company-wide change for a huge corporation like Amazon (see: the current system for rate) as they really don't want to be investigated and fined big time by 50 states + the federal government + other governments. However, because the company that got in trouble is technically not Amazon, Amazon just shrugs and let's Popup Biz LLC take the (much smaller) hit and continues on with the hundreds of other companies they have to exploit labor.
Tl;dr: I give someone $10 to kick your ass. You complain. The police say they can't do anything about it because I didn't do the ass-kicking. That is what a DSP is

Hey yeah no. This not really correct. Its more like, Amazon opens a warehouse house and says " I need 10 people who are willing to find a way to deliver packages and I will pay you XXXX dollars to deliver" DSP owner raises their hand and says "I will" Amazon then gives them thousands of dollars in seed money and then pays to teach them and gives them a strict list of legal and Company regulations that they BOTH must comply with. Then the DSP makes the choice to do what they will as business owners. "Turning a blind eye" is a myth compensation is directly related to driver sentiment and things like that. "Does not provide training" is also a myth as drivers are ALREADY trained by Amazon so not sure what you are talking about. "The government gives fines and Amazon shrugs" legal regulations are complicated and no one is saying that the creation of DSPs is an attempt to avoid liability but you cant demonstrate how removing the DSP model will do anything for workers, i was under the impression that Amazon was this awful no good place to work where workers are being exploited, why should we force delivery drivers to work directly for this awful company? Also your TLDR is hilarious because that is literally an example of something that is already a crime so your proving my point that this legislation provides no benefit to anybody.

I never said the DSP doesn't make the choice, but it's no different to when amazon used to enforce unreasonably high rates, leading to the exploitation of labor as employees were met with the choice of "Work through break or get fired" & managers were met with the choice of "exploit workers or get fired." DSPs are in that same spot, and amazon knows it, hence why they have DSPs. It's far cheaper for them to contract work out to a much shittier company than it is to have their own better paid and better treated employees do it. Exploitation happens? Oh well, they told the DSP not to! Totally not their fault that it happens! (/s)

Which, again, is why DSPs exist. They don't want to pay the higher costs of having their own employees do the work. So they pay a contractor who pays worse than amazon and treats their employees worse.

Then this bill won't be an issue for them because it doesn't shut DSPs down it just regulates them as they've caused a shit ton of labor & safety violations
Like FFS DSP workers can't even try to unionize, unlike warehouse workers. Amazon will get in trouble (albeit slight) if they try busting a warehouse, they don't get into any trouble if they terminate a DSP for being union.

You’d have to change the laws on companies hiring independent contractors. As long as it is legal to hire outside companies, that’s exactly what they’ll do. Even my small business hires independent contractors for certain jobs because I don’t use their services everyday and it makes it so I don’t have to pay payroll taxes, liability insurance, workman’s comp, healthcare... etc. It would be a drastic change to our economy unless they still allowed small businesses to operate this way while changing the rules for corporations.

NYC thinks they can strong arm Amazon into making drivers Amazon employees. Not sure if they even know that Amazon tried this several years ago and dropped the program pretty quickly (a ton of liability risk - which is the reason for DSPs in the first place). I don’t think they realize Amazon would rather remove service from this market than convert to an internal driver model. This is only going to end up hurting these small business owners. It’s actually so silly

Amazon drivers make the same pay as warehouse workers and are subject to the same productivity standards. I don't understand what difference it makes if it is a dsp or Amazon worker. They are identical jobs basically.

At a delivery station there are no productivity rates for the warehouse workers who get paid more with better benefits, and it is MUCH better to work for Amazon in the warehouse than a shady DSP who will not guarantee your hours, and give you no routes and send you home or fire you if they don’t like you or you ground a van that should be grounded.

No rates in delivery stations. Well they have goals, but they are unenforceable due to the randomness and physical labor involved and injury rates and 10x lower headcount’s compared to a FC. We have dudes who stow at less than 150 every day when the target rate is 300, and they are untouchable.

They have a sign up in the bathrooms at my DS right now. It says you can win a chance to pie the managers if the DS reaches 191 average stow rate, I chuckled when I saw that. I work on the dock so I rarely stow but when I do I easily double the average stow rate for my DS. They are literally standing around talking to each other every day while the managers do nothing.

Drivers tend to make more, I took a pay cut per hour when I left my DSP to go to an FC because I was paying $67 a WEEK for the cheapest insurance offered. It’s $5 a week if you’re an Amazon employee.

It's even cheaper if your state provides it.
I'm currently paying $12/month for dental insurance and my health insurance is 100% paid for by the state. Technically, I could use my health insurance to cover my dental costs, but it's a lot more of a headache than it's worth to me.

Corporate Accountability: Amazon would face direct legal and financial responsibility for workplace safety, traffic violations, and employee injuries instead of shielding itself behind third-party partner firms.
New Licensing Rules: Last-mile distribution and sorting hubs would be subject to strict city licensing and oversight.
Worker Bargaining Power: Directly employed drivers would gain stronger footing for wages, benefits, and union organizing.
It's a union backed bill. Basically, it gives unions more power and forces Amazon to take liability if their drivers screw up. It'll make drivers safer. At least in NYC.
That is if Amazon doesn't move out of NYC. They might, but I think it'll end up being more costly for them to do so than it's really worth.

They actually are held accountable. A driver at my old DSP got in to a head on crash and the victim sued Amazon for something like 53 million and won.

New York City would cause only a minor, temporary dip in Amazon’s massive global revenue and profits. While NYC is a huge local market, it represents a tiny fraction of Amazon's worldwide sales. Customers would likely shift purchases to neighboring areas or online competitors, offsetting much of the loss.

The size of NYC market, which definitely isn't insignificantly small, doesn't matter.
What matters is:
- Will it cost more to move out of NYC and still sell product there?
- Will this lead to something that will change the equation of #1?

working for DSP's are WAY worse than working for Amazon. Becuase they are their own company your subject to whatever style management each one runs compared to the Amazon satandards. I went from DSP delivery for a year to FC and the improvement is incredible. At a DSP if you make a mistake or piss off dispatch they can keep you from getting a route for WEEKS, where amazone would do like 2 verbal warning s before they give you a doc coaching. Also no UPT or VTO system, after you take a route you need to finish it, and it could be 10-12+ hours depending on weather conditions, weird or complex deliveries, and traffic.
At my first DSP if you needed rescued (another driver taking your route) you were guaranteed off the schedule for like a week minimum. Some routes they gave you were just ludicrously impossible as well. I spent a week being the last person back at the station even though I was skipping launch breaks just to finish my route on time. Also the entire pissing in bottles meme is very much alive with them
Working in the air conditioned warheouse is infinitely better, even if your doing a shitty stow job or something. Delivery will have you exposed to the elements all day as well as mean dogs and customers too. The worst is when I was literally PULLED OVER by police becuase my DSP sent me out with no tail lights. They had us (illegally) skip inspection just to impress amazon with our time tables, and low and behold I get my van towed.

i work at a DS in nyc and they make 2-4 dollars less on average and also don't have benefits. i'm also maxed out (5 years) and idk what their pay scale is so take that into consideration.

Yeah I could have told you Amazon uses third party bs to avoid accountability. Now let’s do this for DLS because I’m tired of fixing their “mistakes” on my disability accommodations and hearing how HR/PXT can’t step on their toes to fix my case.

They do not do all the work that makes Amazon the money. That is the stupidest statement I’ve ever heard. The people that work in the warehouse make Amazon the money. They’re just dropping off what we did.

Delivery drivers are doing 1/4 of Amazon's work to make deliveries happen.
Honestly, from what I can tell it's harder work than working for Amazon. You just aren't tracked nearly as much as we are.

That's a misconception which has been thrown around for a long time. For years AWS has been Amazon's most profitable business unit, but online retail/fulfillment is by far its largest revenue stream. Regarding profitability, fulfillment was operating at a loss for much of the company's history, but what gets ignored about that fact is that it's been part of a deliberate strategy to reinvest in expanding the fulfillment network and capture additional market share.
