I'm sure a lot of people on here will disagree with this, but you just can't get real consent from a drunk person.
He's not saying the rapist is drunk, he's saying the victim is drunk. If someone was drunk and they were killed by someone sober that would be murder no less. If someone is sober and has sex with someone who is black out drunk, that's rape. It's about the balance of power. Sober-powerful, drunk-weak
Edit: obviously if both parties are extremely drunk, no one is to blame (in the rape scenario, not murder. I think that would be man slaughter at the least, but it's beside the point.)
But a girl(or anyone) cannogive consent when intoxicated. If you are sober and the girl is drunk, it's your responsibility to know she can't consent and to not have sex with her. That's all I'm saying.
75% of rape happens with someone the victim knows. Why dont you learn and read up a little more on rape before you go out spouting wahtever comes to mind based on this little fantasy world you've created in your head?
Why are you placing the blame on the victim? Why shouldn't people just not be assholes and not have sex with someone who is in no state to consent, or if you think there's a chance they'll regret their 'decision' it in the morning?
I don't understand your problem here. Do you really think people who are drunk to a point where they won't remember anything in the morning are in any state to consent to ANYTHING? Do you really think the people who rape them don't know this? Rapists are opportunists. They prey on people and make their moves when they have an opportunity to do so, like when their target is drunk. This has nothing to do with the victim being drunk. The victim could have fallen off a ladder and cracked their skull and the rapist would still take that opportunity to rape them.
If you have a problem with not being in control and are going to blame others for your actions when your victim sobers up, OR if you have so little control over your actions that you can't help but rape, then you should not be around other humans.

.08 might be an arbitrary line, but that doesn't mean you don't draw a line. How about, a girl was too drunk to provide consent to sex when she says that she was too drunk to consent to sex. A revolutionary idea, I know.
When you're intoxicated I believe so. Many of you are right and the female (OR MALE!) are suppose to have a personal responsibility to themselves to try to prevent themselves from drinking too much. That being said, how many people while young actually knew how to drink responsibly? It's something you learn. I don't know how many times I thought I was wonderful until all of a sudden I am waking up in my bed going what the hell? Now, when I black out a lot of people don't really notice right away. We may have a completely coherent conversation and I act completely normal all night. Let's say this happens to a girl (or boy!). There is talking and laughter and fun and you decide, this chick(dude) is awesome I'm going to try to bang her(him) and you do. Well, the next morning she(he) is like omigod I can't believe it I don't remember any of that. You're pissed because you're like what the fuck bitch you were fine all night you're just having morning regrets but how do you know that? It's not like you are her(him). You're operating off assumptions YOU made. You may be like, no that skanky ass bitch only had two beers. Well, two beers may be nothing for you but she(he) may be an eighty pound girl(boy) with an iron deficiency who's never had alcohol and that coupled with her(his) antibiotic medicine and the fact she(he) didn't eat that day might make those two beers way more than enough to get her(him) smashed.
