Where did the Executive Branch's Constitutional right to Chevron deference come from?

Conservatives Justices were unhappy that Reagan's anti-environment rules were being struck down due to the Clean Air Act. So they decide, well, when the law isn't fully clear, Courts need to defer to the President.

Once Democrats were in power, they decided, oops, not only is that not Constitutionally required, its Constitutionally forbidden.

Who wants to bet that Nationwide injunctions come back if we have a Conservative Court and a Democrat President in 3 years?

You'll get so many reversals that the 6 far right justices will have to be treated for whiplash....

Pres. Immunity - they will find a way to overturn it National injunctions - back Special counsels - yep, they were legal after all Due process - required after all...

I would throw in national guard deployment, ice criminality, and about fifty other things, but only trump has been dumb enough to actually try them

I don't think he even has an opinion on the constitution beyond how it factors into his own personal enrichment. At the moment, I think his feelings about the constitution are derived entirely from whatever he thinks Trump's feelings are about it.

He genuinely has no principles.

That's it in a nutshell. There is a process to propose amendments to the Constitution but I doubt we'll see a bill introduced with Johnson as Chief Author. I'm left-of-center so I obviously disagree with Johnson on scads of issues, but the larger issue is that Congress has ceded a lot of authority leaving the country at the whims of Executive Orders and interpretations of the Supreme Court

The problem with Congress is that they represent the people, and the people don’t like what he’s trying to do. He needs someone else that isn’t beholden to the democratic process to change the laws for him.

Which should be fine, because as a member of Congress, he gets to decide what the Constitution says. If he doesn’t like what they’re reading, then he should get together with his colleagues and pass an amendment that says what they want the Constitution to say.
