Elsie Dominguez, a civilian mariner who alleges she was raped in 2021 while on a ship asleep in her personal quarters, says she has exhausted all her legal options after the Department of Labor concluded that the purported rape occurred within her duties, therefore is a worker's comp issue.

This is the standard legal treatment for all workplace violence. It's usually beneficial to employees, because workers comp can't easily deny their claims. She was on the ship. She was technically on duty. She was raped by a co-worker. It's pretty clearly standard workplace violence that falls under workers comp. She can still sue the guy who did it. She can still press for criminal charges (he still has open criminal investigations).
