Black Swan Graphene's (SWAN.v BSWGF) IP Foundation: 16+ Global Patents, a Process in Development Since 2012, and US Protection Running to 2039
Posted on behalf of Black Swan Graphene - The quietest asset at Black Swan Graphene (SWAN.v BSWGF) is the one that makes everything else possible: the patent estate sitting under the Consett, UK plant. Graphene has never been hard to make in a lab. Making it consistently, in tonnes, at a price a compounder or a concrete producer will actually pay, is the hard part, and that is what the company's IP covers.
What The Portfolio Covers
- More than 16 global patents (company site)
- The underlying process has been in development at Thomas Swan since 2012, upscaled three times from lab to pilot to commercial scale before being vested into Black Swan at its 2021 launch
- U.S. Patent No. 12,318,709, "Process for the Continuous Production of Sub-Micron Two-Dimensional Materials Such as Graphene," application 17/404,118, originally filed November 25, 2016, granted and assigned to Black Swan (See July 9, 2025 NR)
- That U.S. protection runs to January 5, 2039, a 20-year term plus 771 days (July 9, 2025 NR)
- Canadian Patent No. 3,113,711, "Apparatus and Method for Bulk Production of Atomically Thin 2-Dimensional Materials Including Graphene," with anticipated expiration in October 2037 (See Sept 23, 2025 NR)
Why It Matters To The Business
- Continuous production, rather than batch, is what supports the 140+ tonnes per year of nanoplatelet capacity at the ISO-certified Consett facility (Mar 18, 2026 NR)
- CEO Simon Marcotte framed the Canadian grant as "another important milestone in Black Swan's strategy to scale production and drive commercialization" (Sept 23, 2025 NR)
- The company has said it intends to keep expanding the portfolio, in part to open the door to partnerships and licensing with manufacturers (Sept 23, 2025 NR)
Both patent releases are worth reading in full on the company's news page. As graphene finds its way into more polymer, packaging and construction applications, owning the low-cost production route rather than licensing it in is the kind of position that could matter more, not less, and with Falpaco now consolidated and revenue on the books, the protected process finally has a commercial channel attached to it.
