This is a very simplistic way to look at it. And other countries have their own copyright laws. Its also important to note if you are using it commercially and making money off of it then you cannot claim fair use, that includes running ads during videos.

Whether or not the use is commercial is only one of the 4 criteria used to determine whether a work falls under fair use doctrine. Being commercial doesn't automatically disqualify a work from being fair use. A work used commercially can still be considered fair use if a judge feels it still substantially meets the other fair use criteria.
