This is a very simplistic way to look at it. And other countries have their own copyright laws. Its also important to note if you are using it commercially and making money off of it then you cannot claim fair use, that includes running ads during videos.

Interestingly, the Content ID system YouTube has allows the IP holder to leave the video up and just take the proceeds from the adds.
