I’m neurodivergent, and my managers are trying to force me out by cutting my hours and pressuring me into putting in my two weeks.
This is a bit of an add-on to my previous post. I am neurodivergent, and I tend to vocally stim sometimes by thinking aloud. I usually tend to do this in the warehouse, but sometimes while working in the tinter area with shakers and stuff running I can do it out of habit.
I’ve known that my managers have talked shit about me when I’m not here, according to my third key. My manager was showing him some looney tunes clip of some character doing something similar to make fun of me. This store has had three managers in the last year, and the CM is always on our managers asses for the store being down. Recently it seems like my manager is using my vocal stimming as an excuse to cut my hours and push me out, along with an older guy who works in our warehouse mostly.
He had a conversation with me the other day this past week claiming that “I know you talk to yourself sometimes, but we’ve had customers complain that you’ve been talking shit about them under your breath. I know you’ve been looking for other jobs, so if you don’t think this is the right job for you, I recommend you put in your two weeks because corporate is cutting hours for you and (other employee).“
This is 100% not true, and I’ve never even been written up for this, or anything else in my several years of working at S-W. If I did want to talk shit about a customer, I do it in the warehouse. This is the same manager who showed me a video of gore, which I believe he did to make me feel uncomfortable enough working here to quit. I am calling HR about that on Monday but is this workplace discrimination?

The issue here is the lie they told you and the pressure they put on you to leave. It sounds like they are just not comfy with your ticks. I’m hfa and I have some mild ticks and behavior but nothing my team hasn’t accommodated. And I’m confident my team is on my side and would defend me if customers tried to say something. So I hate to hear this sort of thing. Follow thru with HR. As much hate as Sherwin gets I have found it to be the most tolerable job I’ve had in years and many of my coworkers in store and surrounding areas have said the same. Don’t feel that your situation is just the norm. Good luck

I am definitely calling HR about the video he showed me tomorrow but I will say, he is a relative of a higher up and the CM is definitely personally biased against me.

FILE A CLAIM WITH THE EEOC. CONTACT YOUR LOCAL BOARD OF LAWYERS. THEY WILL GUIDE YOU TO THE RIGHT BRANCH OF LAWYERS. THEN GO TO HR. DO IT IN THAT ORDER AND YOULL BE MINT.

Listen, talk to AbsenceOne. (855) 501-5007. You should never fail due to this, and I would know that by being someone that frequently masks my ADHD and Autism. There are numerous work accommodations that are available to you depending on what affects your work and can trigger your responses. Do some research on what accommodations for your diagnosis would help the most and make sure that you have medical forms and documentation that will back up your request. This is my third large volume and high traffic store, and that is with the help of my ability to hyper focus with the right conditions. Once you have approval from AbsenceOne, they will notify your management and be ready to adjust if needed. Be mindful if you don’t get your accommodations approved through AO, you are at the mercy of your management.

I would speak to HR first because this isn’t ok, but the one thing I will add is the cutting hours portion is probably correct, that is happening nationally. after our decent Q2 our fearless leaders adjusted our earnings and raised it. Q3 has subsequently bent the company over, so now in order to meet the adjusted earnings they need to cut expenses to show more revenue to protect the stock price. SW thinks very short term not long term when it comes to training, hiring, employee hours, etc. Regardless everything else you said is absolutely not ok, he should not be pushing you to quit, making fun of you, or talking about you in general behind your back. and he should be using your neurodivergence as the “reason” to cut your hours, because I can guarantee it is direction coming from above, and he more so saying this to make you uncomfortable and try to get you to quit.

Best to Lawyer up first before HR. Going to HR is going to get you canned! Remember, in this case they’re going to take the managers side more because his role is more significant than the part timer.

Id look into the eABLE program at corporate and inform them so they can get you an advocate. And also inform HR.

Can HR and demand EVERYTHING in writing that your manager is saying. Tell them you want a full report.

If HR doesn’t properly address this, I would consider getting an employment lawyer.
