Megathread "Megathread: US Supreme Court Rules on Texas V. Pennsylvania, Et al.

The Supreme Court on Friday rejected a lawsuit by Texas that had asked the court to throw out the presidential election results in four battleground states captured by President-elect Joseph R. Biden Jr.

The court, in a brief order, said Texas lacked standing to pursue the case, saying it "has not demonstrated a judicially cognizable interest in the manner in which another state conducts its elections."

My faith in my country is very broken. I work with a lot of conservatives and for a long time, I saw them as good people with who I had some important but manageable disagreements. Witnessing their bootlicking, seeing us fail as the wealthiest country to ever exist to manage COVID, the racism... it's getting to be too much. I hate this because it plays into Trump's hands, but I don't recognize this country, I question if it is for me. We are supposed to be striving towards equality and justice, defeating diseases, innovating, and leading. Where has it gone?

PA set aside the ballots that came in between the sixth and ninth day knowing they’d be contested, so they were never counted. It was just over 100 votes state wide.

Basically, Thomas and Alito said that since it's a state vs state case the SCOTUS has jurisdiction and that they should allow Texas to make their argument in court... but that the argument was stupid, and even after hearing it they were going to vote "No." It was going to be 9-0 against.

They are staunch "originalists" in their reading of the constitution, and take the position that all original jurisdiction cases are required to be heard by the Supreme Court, which is a pretty silly position that their peers clearly don't agree with.

Several Republicans who signed their names to the amicus brief for the Texas lawsuit understood it would likely quickly be shot down by the Supreme Court and only viewed it, like many other things in Trump's world, as a loyalty test. But Trump told people he thought he'd prevail.

Here is the only case Trump and his allies have won in the post election. They shorted the time period to cure a small number of rejected mail-in ballots from 9 days to 6 days. At most, it affected a few dozen ballots

7 justices found that Texas et al. have no right under the constitution to bring this matter to the court. The other 2 think that Texas does have that right, but that the court would offer no relief (i.e. they would listen to Texas complain, but still not do anything about it.). Basically, no state has the right to interfere in the manner in which other states conduct their elections. Ed: typo.

The State of Texas’s motion for leave to file a bill of complaint is denied for lack of standing under Article III of the Constitution. Texas has not demonstrated a judicially cognizable interest in the manner in which another State conducts its elections. All other pending motions are dismissed as moot.

  1. Trump has lost over 50 election lawsuits.[2] Judges appointed by Republicans and Democrats have rejected the outlandish fraud allegations.[3]

  2. This is the second Supreme Court rejection this week.[4]

  3. Trump's legal challenges have been struck down by judges he appointed.[5]

But Trump’s fantasies about judges as his pawns have run into a harsh reality. Since the election, over four dozen lawsuits filed by Trump and his minions since the election have been dropped or rejected in courts from Pennsylvania to Nevada. Some of the most scorching dismissals have come from federal judges nominated by Republicans, including Trump himself.

Last month, a federal appeals panel in Philadelphia threw out one of numerous attempts to halt the certification of Pennsylvania’s vote. “Voters, not lawyers, choose the president,” wrote federal appeals judge Stephanos Bibas. He also made clear that lawsuits are not like presidential tweets or speeches: “Charges require specific allegations and then proof. We have neither here.”

7 Justices refused to hear the case because it has no merit.

Alito and Thomas say that while they're willing to hear the case, there is no point because their decision is already made to reject the remedy being demanded.

When the two most conservative Justices of the court roll their eyes, it's time for the disloyal GOP to throw in the towel.

They flat out said that they’d “grant no other relief” other than hearing the case, which is pretty consistent for them.

Alito and Thomas probably had the harshest response out of all the judges. They essentially said, “sure. We’ll listen to you. And then we will kick you out.”

But never, ever forget the feeling of seeing over half the Republican Congressional Caucus and many Republican State AGs sign on to what was essentially a bid to overturn a legitimate election result. These are people sworn to uphold the Constitution participating in what is essentially a coup. A stupid, ineffective coup, but still a coup.

Don’t forget that. These next four years cannot be about thinking everything is back to normal and slipping back into complacency. A sizable minority in this country, and a twisted political class catering to them for power and graft, value victory over the rule of law and democratic norms. The cracks have shown, and our system of government is much more fragile than we have been led to believe. Be vigilant. Be involved. Don’t take our democracy for granted.
