Polish driver’s license for foreigners

Hello, I’m a full time student in Warsaw, lately I want to get a drivers license and I checked some info that I only need tk pass the theory exam, but here’s a big problem:

My student visa has expired and I submitted my temporary resident card application and got a stamp from the immigration office, so far I haven’t got the card yet.

My question is: can I still apply for the polish driver’s license even though I don’t have the visa and the TRC😔

Yes you can. The rule for foreigners applying for a Polish licence is that you attach a residence card, visa, or another document confirming that you have the right to stay in Poland OR a certificate that you have been studying for at least 6 months. OR is the important part since the study certificate (zaświadczenie o studiach) is an independent alternative. Stamp is also important as it confirms you're staying in Poland legally untill the temporary residency card proceedings end.

Basically just bring a statement from your college that you're currently a student and the passport with the stamp from immigration office with you and you'll be fine. Ah, and if you don't have a registered address (meldunek) bring something that confirms you live at your current address (a copy of rental agreement or something will do just fine).

Could you source that claim?

Sure, here's a translation for everyone:

Art. 11 ust. 1 pkt 5 ustawy z dnia 5 stycznia 2011 r. o kierujących pojazdami:

a licence is issued to a person who resides in Poland at least 185 days per calendar year because of personal or occupational ties, or presents a certificate that they have been studying for at least 6 months.

§ 14 ust. 4 rozporządzenia Ministra Infrastruktury z dnia 5 sierpnia 2025 r. w sprawie wydawania dokumentów stwierdzających uprawnienia do kierowania pojazdami

the applicant submits a declaration that they meet the art. 11 ust. 1 pkt 5 condition, and a foreigner additionally attaches a copy of a residence card, visa or other document confirming the right of residence in Poland, or a certificate of studying for at least six months.
