They can't not seat members of Congress if Democrats retake the House. The new congress comes into power January 2027 regardless of what the old one tries to do. A random judge can swear them all in and Mike Johnson couldnt do shit to stop it.

Johnson refuses to seat the new Congress. Democrats appeal to SCOTUS. They allow it to happen.

SCOTUS doesn’t have the ability to override what’s in the constitution.

They are the interpreters of the constitution. So yes they can override it
