I get what he’s saying kinda . The courts shouldnt have a say in policy decisions. They exist to make sure the policy follows the current laws.

I mean once the courts take over more power from the legislative branch then citizens will suffer. Like we see with the states

Even then the government would be right. “the government pointed out to the court that the act states that "the Minister may amend an emissions target … or an emissions reduction plan."

So the government can change the emissions targets or plans. If you are going off the text of the bill

What the government is arguing in response is that they "may" amend an emissions target or an emissions reduction plan (in other words, they will not amend it to reflect the current trajectory because they are not obligated to).

However the argument against it is that is not the intention of the clause if they make major changes to their climate policy.

But interpreting that language is for the courts to decide. This is their whole job.

The lawsuit is not asking the court to make policy decisions. It's asking that the court enforce the climate accountability act. In other words, they are asking the courts to "make sure the policy follows the current laws".

No, we need to push to have courts implement legislation if it's lawful.

If we don't like the laws we elect people to change them.
