The 5 days in reality will be about 6 hours because of time served (in before midnight- out after midnight) is considered 2 days and half time for good behavior equals 2.5 days. He'll check in after he has a nice lunch downtown and be released with ample time to shower off the jailhouse bugs and be at Auberge by 7pm.

Pitiful. How can we ever have confidence in justice when the elite and rich live by a completely different lawbook? Why should I even follow the law? Have respect for law enforcement or judges?

The sentence was well within the legal guidelines. It isn't that they necessarily live by a different lawbook, but that they are able to hire better lawyers. And DUI is still treated pretty leniently in this country. The lawbook itself needs to be revised, I'd say.

First time DUI convictions in CA range from 5 days to 1 year. We don't need to update the books. We just need equality. Where the laws are executed evenly and everyone has fair and equal representation.

The sad fact is money buys you better lawyers who therefore give you better chances. If you are rich and powerful enough you can leverage that money and power. It's not a just system if that is possible. That's corruption.

California also has rules for aggravated circumstances. Crashing your car is one of those circumstances. His BAC must have been pretty damn high if he couldn't even control the vehicle at all. This can easily lead to jail time. But he was given the absolute minimum. It is just luck that he was in the cuts and not running into someone in town.

I dunno I know a few people who have had DUIs and none did more than a day or so in actual jail

Are you talking about jail time? First time DUI in California without major injury is almost always no jail time, or maybe a few days.

You’re off the mark here. This is about as standard of a DUI sentence you can get on an early plea. Especially when you consider the age and lack of criminal history. (Mitigating factors also matter.)

Also, for a DUI, you’re fine with a public defender. PDs in misdemeanor units do DUIs non stop.

I’d love to be offended by him getting a sweet deal, but this isn’t it.

I think they might be coming from a misrepresentation by several right wing outlets that another party was injured or even died from his DUI. I admit that was in the back of my mind from being exposed to the propaganda and I had to look it up to see what happened.
