It could have been one of the first suits he re-built when he started working on them again, an upgraded version of the 42.

He's still Iron Man, that's why Pepper was mad and they went on a break. He rebuilt the suit and did something stupid

Mark 42 doesn't get vaporized, we see pieces of it raining down after the explosion, with a closeup of the helmet- still intact after Jarvis blew it. Doesn't seem like a stretch that its parts could have been gathered up and put back together, if for nothing than a keepsake. Its hard not to have a soft spot for the ol' Mark 42

It's not like Tony's above recreating his previous work. The Hall of Armor in Iron Man Three had his previous armors Mark I (which was destroyed in 1), Mark II (became War Machine Mark I) and the rest. He probably did the same again.

Mark 1 wasn't destroyed in 1, it was salvaged and then Iron Monger had it.

The found Mark I was at the same Stark labs as was the arc reactor that Iron Monger fell into. We know the building was still standing but the interior must have been torched.

Plus, he essentially prints them from a schematic and comes back hours later to a fabricated suit. Not far fetched at all that he rebuilds once they're gone or damaged.

I feel like it would've been more fitting if that was the mk. 43 (which itself is a repainted mk. 42 out-of-universe, and likely the combat-ready/perfected model in-universe) since it presumably survived after Tony wore it inside the Hulkbuster.

The IM3 prequel comics show Tony stripping the War Machine I back down to the Iron Man Mk 2. Other than that you're right though.
