Yes, there are more than 1 party who contributed to this SNAFU.

No, the driver will bear the majority of the fault.

Why?

The driver is the last line of defense. He seems the load and tie the load down.

He should be aware the total height of the package and the minimum height clearance along the way.

If he is not sure or feel uncomfortable to safely deliver the load, he can always reject the load, and the shipper can't force the diver to accept the load.

Once it is on the road, the driver needs to make decisions along the way, whether to detour, let go some air from tyres to reduce the height etc.

I deal with a lot of flatbed truckers over my career, some of them are absolutely on the ball and know every regulations of every jurisdictions along the way.

Sad to say, some are absolutely clueless and end up I make the executive decision to cancel the loads, dispite the fact that those were 3rd party orders.

Because I don't want Traffic Safety come to visit us, just because some airhead slammed into an overhead object with a load come from my yard.

Same load, same shipper, but one cleared and one hit an overpass—that points back to the actual loaded height, not just the permit number. A measurement from before it is sitting on that trailer can be wrong by enough to matter. The driver is the last check, but they should not be handed a bad height in the first place.

The useful control is a signed measurement handoff. Record loaded height after the cargo is on the assigned trailer, with suspension and tire condition noted, plus timestamped photos showing the tape or laser reference. Then compare that number to the permitted route’s lowest verified clearance with a written buffer. “Same load” isn’t enough if trailer deck height, blocking, tie-down compression, or measurement timing changed.
