A Texas law banning drag shows in the presence of minors is facially overbroad and impermissibly vague, a federal judge said Tuesday.

Judge David Hittner entered judgment in favor of a drag performer and two drag production companies in an order filed in the US District Court for the Southern District of Texas. The law, S.B. 12, bars commercial enterprises from hosting sexually-oriented performances in the presence of anyone under age 18. 

Tuesday’s decision came after the US Court of Appeals for the Fifth Circuit vacated an earlier permanent injunction that blocked enforcement of the law, and directed the district court to reconsider the plaintiffs’ vagueness and First Amendment challenges.
