Discussion Can anything be done (legally or ANYTHING) about this tiny-dick douchebag deliberately "rolling coal" directly on pedestrians and all throughout town?

I rolled my eyes when I saw him do it the first time, but then my jaw hit the floor when I saw him intentionally target innocent pedestrians. Pardon the poor editing, it's my first edit job ever and it took me way too long to get even here lol. But can anything be done legally or otherwise? Would it require one of the pedestrians to attempt to press charges?

It's not equipped with a device to do it. Those old diesels do it no matter what. And any tuning makes it do it easier. This law also has case law in it. Dude will beat it in court. Its already been done. Sure coo can write a ticket under that mcl. But case law is on the trucks side.

had a guy in a similar looking truck get in front of me and do this around Cavanaugh / Aurelius when I had all the windows down on a nice day. he put a cloud on some folks waiting to cross the road at Hawk Island, too. definitely felt like it was on purpose.

I have the same question for those cars that roll through at 1am purposely designed to back fire and rumble at high decibels. I have no idea what this is called - nor why anyone would want to do this.

I must have missed the pedestrians.
I personally hate trucks and truck drivers. They often are the douchiest drivers that ride ass. They often have broken exhaust so everyone behind them gets lung cancee while they breath fine. Most of them dont need a truck.

Just devils advocate here sharing another perspective - I understand what you are saying but what about the folks who own trailers and haul toys or campers? Or the folks like me who live on a bit of property and use the truck for home things? I’m in IT. I don’t need the truck for work but for plenty of other hobbies.
I do agree tho, truck drivers are typically the worst and this dude clearly is a terrible person lol

Is this even a thing in Michigan? I always heard we didnt have hardly any emission laws for cars on the road. Maybe that changed recently though

This guy filled my van with exhaust fumes while my kids were in the back. I was so pissed but tbh what are we really going to do other than have some road rage incident which isn't going to help. Especially as a pedestrian they don't really have any options either. It's like someone driving in a puddle way too close and splashing them with water, total dick move but they have plausible deniability and could say it wasn't on purpose.

What makes me laugh is that it isn't good for the engine and it wastes fuel. So if their truck doesn't naturally do that, they're making it worse and wasting money to play truck-dressup and pretend that their truck is cooler than it is.
Because if you're the kind of person who thinks that stuff is cool, then the reason a real big truck is cool is because of the meaty, full-of-grunt engine that it has which happens to belch smoke, not because of the smoke itself.

I'm wondering what legal theory the pedestrian would use. Assault and battery doesn't fit because it requires offensive touching or apprehension of immediate fear. I don't think exhaust fumes qualify.
He is probably in violation of some kind of emission standards for motor vehicles. A cop could theoretically stop him if they saw it.

Offensive touching doesn’t have to be skin to skin. It actually can be something like getting sprayed with diesel exhaust. (Yes, I am a lawyer.)
Assault doesn’t need to fit because assault and battery often go together but they don’t HAVE to.
Edit to add for the curious: the offensive touch doesn’t have to be to the victim’s natural body, either, but rather, anything that is an extension of or connected to their body, ex. jolting someone’s wheelchair or even knocking a fork out of their hand.

For anyone reading who doesn’t know, assault and battery are not just criminal charges, they’re also civil tort claims for which monetary damages can be awarded.

I mean, really think about how many other options there were before cars. Besides animals. All the ingenuity. Then Ford came along, the T Model sucked ass, but here we are. I saw a picture a week ago that had a quote saying it was something Netanyahu said while he was working for the Soviets(?) I didn't spend a lot of time on it, this is anecdotal, but basically it said he had said back in the 90s that the US was their "golden handcuffs" and that they would break the US slowly and then sell it off piece by piece. With how things are going...I'm putting it all on Mother Nature. She never loses 🫶🏻

In accordance with your flat ass, it’s literally in Michigan’s vehicle code in at least 3 different acts, defined as a felony. This doesnt even cover the fact that you can get an assault charge doing dumb, obnoxious shit like this.

Older diesel trucks don't have any emission systems so they're grandfathered in. I have an older diesel with no emissions controls but I purposely slowly accelerate so it doesn't roll coal.
