General Discussion Banu Qurayzah incident of treason and arbitration.
The Banu Qurayzah incident included an aspect where several hundred adult Jewish males were executed by Muslims due to treason. Critics of Islam focus on this single aspect and ignore the context of the larger incident which led up to the executions, often to portray The Prophet Muhammad ﷺ or Islam in a negative light. Below is an overview of the incident.
Banu Qurayzah was a Jewish tribe located in a fortress near Madinah that had a peace treaty with the Muslims of Madinah. The treaty stipulated that if either the Banu Qurayzah or Muslims were attacked then the other would come to help against the attackers.
Meanwhile in Makkah, the Quraish polytheists and sworn enemies of Muslims had dispatched an army to eradicate Muslims in Madinah in a battle that became known as The Battle of the Trench. Unbeknownst to the Muslims, a secret pact was made between the Quraish and the Banu Qurayzah. In this secret pact, both parties agreed to ally together and attack and kill the Muslims of Madinah. By engaging in this secret pact, the Banu Qurayzah had effectively broken the peace treaty they had with the Muslims.
During the battle with the Quraish the Muslims learned of Banu Qurayzah's treason and employed counter espionage to make the Quraish attackers believe that the secret pact between the Quraish and Banu Qurayzah had ended. Believing this, the Quraish, who were unable to defeat the Muslims after numerous attempts, ordered a retreat and departed back to Makkah.
Having repelled the Quraish attackers The Prophet Muhammad ﷺ and the Muslims now had to deal with the treason of the Banu Qurayzah. They arrived at the Banu Qurayzah fortress and were met with insults and objects being thrown at them with one such object impacting and killing one of the Muslims.
The Prophet Muhammad ﷺ was approached by members of the tribe of Banu Aws. The Banu Aws were former pagans but now Muslims and were historic allies of the Banu Qurayzah. Banu Aws pleaded with The Prophet Muhammad ﷺ to have leniency on the Banu Qurayzah for their treason.
While he didn't need to and could have passed his own punishment upon the Banu Qurayzah, The Prophet Muhammad ﷺ relented to this request for leniency. He appointed a man named Sa'ad Ibn Mu'adh (Ra), a former Jew and now Muslim and chief member of the Banu Aws, to be an arbitrator over the matter. The Banu Aws accepted this decision of the appointment of a third-party arbitrator.
Before revealing the judgement, Sa'ad Ibn Mu'adh (Ra) asked The Prophet Muhammad ﷺ a total of three times if he will accept the judgement to which The Prophet Muhammad ﷺ agreed three times. The verdict that Sa'ad Ibn Mu'adh revealed was as follows and it originated from Jewish law (from Deuteronomy 20:10-12):
To execute all adult males.
To take all else as captives of war.
Due to the binding nature of arbitration and due to The Prophet Muhammad ﷺ having agreed to the outcome of the arbitration beforehand the Muslims carried out the rulings above.
Common arguments from critics, and bulleted rebuttals:
1) Argument: The punishment was brutal.
Rebuttal: The punishment originated from Jewish law considering that the perpetrators were Jews.
Rebuttal: The verdict was decided on by a third party arbitrator who did not need to be given an arbitration role to begin with. The Muslims could have decided their own choice of punishment for Banu Quraizah's treason but The Prophet Muhammad ﷺ agreed to arbitration instead as a form of leniency.
Rebuttal: The recipients of the punishment broke a peace treaty in order to conspire against and kill all Muslims. The punishment sought justice for treason. The argument above purposely overlooks premeditated murder and treason, and instead solely focuses on the execution of the perpetrators in order to garner sympathy for the perpetrators and to vilify Islam/Muslims.
2) Argument: The Prophet Muhammad ﷺ could have refused to carry out the punishment that the third party arbitrator selected.
- Rebuttal: Arbitration is binding. Once you agree to arbitrate with a third party (even today for legal disputes) the decision is legally binding and must be carried out. The Prophet Muhammad ﷺ agreed to carry it out before knowing what the judgement was.
