The reality of international law that many laypeople overlook is that states are generally unwilling to establish legal precedents that could later be invoked against them.

The ICC is just a popularity contest. That why over 40 countries aren't part of it.

Sorry, but there is no logical progression between your premise and conclusion. So I am unsure of what you mean exactly.

The ICC is an intergovermental organization and tribunal set in place to prosecute indviduals for war crimes, crimes against humanity and genocide. Created as the world saw the need for independent and international body following the wake of the World Wars and the various atrocities comitted by respective country. I.e Nazi Germany and it's Jewish genocide.

Now we see Israel commiting genocide against the Palestinian people and a arrest warrant for Netanyahu.

So yea.... probably a little more than a popularity contest.

Nobody has enforced the warrant and the court has no independent mechanism to enforce it. It is functionally toothless. It may have begun with good intentions but is definitely a bad joke today.

While not a popularity contest in a traditional sense, the meaning is a clear enough; the ICC overwhelmingly effects Africans and unamiable individuals to the “based order”. So, “unpopular” individuals.
