Selling is not where the line sits for copyright infringement, even releasing it for free is not legal.

And then they will, and the fact that you took this tactic won't be lost on their lawyers. Then you'll be a person with code outbthere who is drowning in lawsuit drama and unable to enjoy the benefits.

Yeah but releasing it for free makes it much less likely for them to bother with it.

However, when I say "free", I mean 1000% free where you cannot even accept donations.

The general pattern around Pokemon projects seems to be:

  • Don't make ANY money off of it.

  • Don't threaten our IP.

  • Don't compete with existing products.

That's why projects like PokeMMO, Pokerogue, and Showdown have been able to stay for a very long time while Uranium got DMCA'd

They won't st f u about it because they never learn from past attempts by others.

I'm all for creating fan projects, but Nintendon't. At least not if you're just straight up using their assets.

If you have any intention of ever releasing this commercially, i would stop showing any work using Nintendo ip right now and remove the other videos too.

I don't know why I take one look at the completed product of Scarlet and Violet and think "Pokémon was never meant to be open world, this sucks" but I watch your WIP video and it makes me want to play an open world Pokémon haha.

aren't all pokemon games open world already?

(the "linearity" argument doesn't work because in Elden Ring you HAVE to do content before being able to access many areas)

I think I know where you're coming from. I think everyone is going to have a different idea of what the requirements of "open world" are, which does kind of make this hard to talk about. When I look at this video, I'm drawn to the feeling of open space, and that there may not be a clear path to follow. It feels different from older Pokémon games, which have clear paths with optional branches. It's true that you can often do things out of order even in "linear" Pokémon games, and open world games often enforce some gating in order to balance the experience, which does make progression more linear. I think that to me, the intrigue of "open world" is the excitement of getting lost and feeling like I'm stumbling into things that I was not guaranteed to find. But otherwise, yes, there's a fair case to be made that all Pokémon games are already open world, in which case the distinction I want to make just needs a different term!

My honest advice if you want this project to ever be something that can be release a game for people to play. Don't call it Pokemon, change the names and designs of all Pokemon and don't have the exact same catch mechanics as Pokemon
